Issue with my apt complex management.

Well my lease is up in mid October and since im travelling for 6 weeks i decided not to exntend my lease so I walk in the leasing office and tell them Im here to pay prorated rent for October.

The manager told me I cant get out coz there's 60 day notice required. So basically im screwed and have to pay rent for another 2 months. But that was my fault coz i didn't read fine print page # on their 20 page contract.

But im not mad about, im mad about the fact that they want to charge me more for those 2 months (60 day notice). And manager's excuse is :

"You're out of your contract and basically paying month by month, and for that we can charge you what ever we want"

I asked her "is that in your contract?" which she replied "yes" and started looking for that statement. She failed to find it and just told me " Well it's not in the contract but we have a right to charge whatever we want when its month to month"

So Im not sure what i can do. My flight is on Saturday and basically i don have time to argue with that ho. Not sure what to do.

Or i might be wrong maybe they can in fact charge me whatever they want, can they?

Unless you signed something in writing that says they can charge you what they want then that's illegal as far as i know. I had a class with a girl who was in a similar situation who sat to my right, and to my left was a girl who's father is a major attorney in the area. Go figure? lol I'll try to get ahold of her and find out what ended up happening there.

But she said i don know what ur plans are but if we don receive the check by first of Nov, we'll report you to 3 collection agencies.

Unless you signed something in writing that says they can charge you what they want then that's illegal as far as i know. I had a class with a girl who was in a similar situation who sat to my right, and to my left was a girl who's father is a major attorney in the area. Go figure? lol I'll try to get ahold of her and find out what ended up happening there.

Funny thing is i asked the bish if i could talk to smbdy else and she said she's the manager. And i was pissed so i said there's gotta be smbdy above you.

And she said you'll basically have to go to court.

If you did not sign a new lease you automatically go to month-to-month, they can not do shit other than possibly get you for a partial week in November unless there is something in the contract stating 60 days which I have never personally seen.

I would do what Johnny said and put your shit in a storage facility and then keep checking your credit report every other month or so for a year, if it shows up fight it and you will win. Just make sure you keep copies of all of your papers, payments, leases etc.

Call and attorney and run it by them. Most will offer free consultation. Take them a copy of your lease.

Hit up the phone book and find a local lawyer, sounds stupid but they'll tell you who's in the wrong for free most of the time and what you steps you can take to resolve this.

Also here in MA we have something called the governors consumer affairs office, not sure if they have anything like that in TX but they have been helpful to be for all kinds of issues in the past and will pretty much be able to tell you what your options are right over the phone.

if you're going month by month because your lease is expired, then technically, the 60 day notice requirement is expired too. Move your stuff to storage and be out before november.
