Issue with my apt complex management.

If they have the terms of vacating in the lease...i.e you must give a written statement 60days before you move out, then they can get you for the remainder of those two months. Most leases automatically renew at the end of 1 year anyways. So they are being nice to you in saying that it goes month-to-month. They could have gotten you for another full year.

Pay the 2 months and never ever move there again, or suggest anyone to move there.

 
Its Texas. All renters in Texas require 60 days notice before vacating. They can and will charge you whatever they want by going month to month. Usually an extra 50- 75 a month. An apartment or landlord is not allowed to extend a lease without you signing it.

You can probably fight it on a technicality since I know it is easy to break leases in Texas but nopt sure how strict they are on the 60 days.

But seriously. If you're paying month to month they can only charge you for when you live there. The lease is up, you signed no extension contract or anything therefore the contract should be void as well. The "2 Month Notice" only applies to while you are under the lease contract...

I think that bitch is trying to pull a fast one to make some money off you.

 
Well called the lawyer she said I will have to pay those 2 months for sure.

And she said they DO have a right to charge whatever they want from month to months.

that was the only real estate lawyer I could reach in my area. Others charge even for consultation $125

She said you have right to refuse and deal with collection agencies which I dont want to do.

 
what he said. we have a few rental properties ourselves and they wont come after you for such a petty thing especially if your lease is up

Aparment complex is owned by different company. And another one runs all the financial part of it. Rent, new lease, lease renewal and all other crap

I am thinking the same thing. The 60 vacate notice is for breaking a lease, if the contract is up and they dont have a law that automatically renews the contract or if it doesent state that in the original lease then they cannot apply that rule im thinking. From my experiences when in college, these apt complexs are shady and prey on the lack of experience of young people when it comes to leasing/legal matters and figure they can get away with anything

Pretty much the only way you would be able to negotiate would be through collections. But that would also hurt your credit.

well just beecause she's the manager there is still a leasing company that controls that apartment complex and they're the ones you need to talk to
