im taking legal action for X amount of dollars and i need help writing out the Complaint Form i am filling it with FACTS and i am wondering if there is something i should say or not say and so on. I dont know who reads these letters but i just need ideas on how to fill it out. here is what i am filling out

thanks folks i am taking a stand against internet punks.i didnt know its not considered criminal to scam someone,its civil which is why the police wont/cant do anything. Its breeeeech of contract so i gotta sue him to get my money back...

 
fact that he had to scam you i bet he doesnt have any money your gona end up spending more on legal fee's or whatever then what the money is worth that your sueing him for..not to mention it wont be a overnite thing,i say just charge it to the game.

I filed a complaint with the BBB and they tried to handle the situation but nothing came from that. After evaluating everything, I decided not to sue them but indirectly sway people from their business.

In the end I sold the wheels for about what I paid for and the store went out of business. Karma is a *****.

did you even read the story? he is not broke and has a job, its people like you that allow people to get away with stuff like this. I am going to do whatever i can for as long as i can to get my money back and criminal charges brought against him. if he doesnt pay then i report him and he gets arrested then jail and so on and so on. ill make this 300 bucks ruin his life if i have to, i want my money back. scammers cannot go unpunished.

they may have been wrong but you did come out with something,this kid got my money lied,then got ups' money and kept it, he would not have had to come out of his pocket to make me happy. he insured the hu and got paid,all he had to do was keep the money i paid him and refund the money from the claim and we would both be happy......but he had to be a bastard,im getting my money back, if he doesnt show up for our court date he goes to jail,if he doesnt pay , he goes to jail, either way justice must be served..........oh and i want my money back

cant you sue for the amount that he stole from you and the court fees? i've seen it done on like judge judy and shit before lol.

I believe he can sue for the amount, attorney fees, and treble damages resulting from the dispute. I don't know if varies from state to state, or if it is federal though.

yup im sueing for cost of the hu+what he got from ups+court costs+hotel+gas+rental car if i dont drive my own car+time off of work= justice... i dont know how to calculate damages and mental anguish so im not gonna bother with that..i just want facts and numbers i can justify.

 
your best bet is to file a small claims suit against the store, not the employee. most states allow you to sue for a max of $5,000 in small claims court, the filling fee usually only casy about $100.

DO NOT SUE FOR MORE THEN DOUBLE THE H/U, when the judge hears your case and if the h/u costs $500 and you are suing for $1500 the judge will feel you have been exagerating, believe me inknow this.

i have successfully taken paypal to small claims court and won, they had locked up my account that had about $1000 in it because some one used my brothers account and had a negative balance, yues they blocked mine because of the same last name!! ended up winning a little over $2000 for it

make sure you use good verbage and not slang in the original filling and state only facts, all the details will come out in the court hearring.

Treble damages are more than likely detrmined by a jury (or judge if jusry trial is waved). Just something to keep in mind. I am going through a similar process myself and hope it works out for both of us!

realy? not more then double? even if i have fact to back it up? do you think my wants are unrealistic? all i want is my money back and court costs and what it costs me to get there in the first place....so the time off of work thing is a bit much you think? i am going for around 1200ish + court costs maybe a little less but not more and the hu was 311..I dont think he should gain anything at all so i really need to start at 611+ since he DID get paid by me and ups.

the ONLY reason i cant do this is because the recipt he supplied me was from him not the store. I cant prove the store was or is involved. all i can prove is what i am stating,granted i can tell you some stuff that would make you think the store is involved but i cant PROVE it. ie the fact that the story of me buying it from the employee didnt come into play until they tried to rip me off,this was going just as a normal warranty transaction should until ups broke the hu. Then all of a sudden the store didnt sell it to me the store sold it to an employee and i bought it from him...but th hu was returned per the store,returned to eclipse per the store and warrantied by eclipse to me through the store but i didnt buy it from the store? BS.

 
I'm pretty sure you are entitled to sue for any costs you incur during the pursuit of this case. Car rental, motel, meals and court fees just to name a few. When a person is convicted of wrongdoing they're responsible for every and anything associated with that "crime".

Being entitled to sue, and actually recovering the costs are two different things.
