i'm gonna sue a scammer FTW!!!!

yup im sueing for cost of the hu+what he got from ups+court costs+hotel+gas+rental car if i dont drive my own car+time off of work= justice... i dont know how to calculate damages and mental anguish so im not gonna bother with that..i just want facts and numbers i can justify.

i highly doubt you'll get hotel money and that shit. i didn't read the story but why did you need a hotel for a headunit? //content.invisioncic.com/y282845/emoticons/confused.gif.e820e0216602db4765798ac39d28caa9.gif

Being entitled to sue, and actually recovering the costs are two different things.
very true, nothing says he HAS to pay,but if he ends up in jail that would be good enough for me. scammers must pay one way or the other. Internet crime is getting out of control because people dont pursue it,we have to get these scammers!!!!!!!!!!!!11

I absolutely agree, but a civil suit is not going to land him in jail. More than likely what will happen is that you will receive some type of summary judgement against him (if he does not pay), which in turn can be filed as a lien against personal property (depending on the state).

realy? I thought that was just as if you ignore any other court order like if he fails to pay the court costs or something? summary judgement against him i guess i need to find out what i can do with that if this does happen? maybe i can drive up there and take his SPL s10

I don't think it applies to all personal property, a lawyer would be able to clarify better than I. Yes, theoretically, if he were to not pay court costs and judgements against him, he could be found in contempt . . . . . . realistically, I don't see that happening over $500 or so. Just my .02, but your lawyer would now better.

good point i should just be asking him all this stuff:) ......he may be a family friend but im not sure if he is gonna come with me which is why he is guiding me and not doing it all himself.... i didnt mention to him that this was in another state i just kept telling him i was ripped off on the web. I dont think he will want to drive and ill have to ask him if he thinks we can gets fees for him and airfair and so on....he wont be back till the 28th so i dont want to do anything till he replies to my letter that i drafted...

Have you tried talking to the credit card company or bank to take the money back....I ordered some performance parts for my car about a year back and the guy kept telling me they were backordered and then shut down his website. The BBB and Consumer Affairs just kept sending emails and doing nothing...I called up Wachovia since it was a check card and I had my money back in 3 days....try it out and see what happens, you may be pleasantly surprised.
