Alright guys... so a girl got drunk and made up a story I assaulted her to cops... Not a big deal, she since told the police she made it up but I still have to go to trial for it... Not worried. Was already told by police I will most likely be told I am innocent before a real in court sentencing date or however they do it anyways...
One of my conditions before she originally had me arrested was to have no contact with her... no phone calls, computer messages etc.
I have followed this 100%. She was not supposed to have contact with me also, however she did not follow this. She left 7 messages on my phone's answering machine explaining how she's sorry she made it up, she wishes I would talk to her, and even admits how she would just like to hear me say 1 word to her...
But, I still say f**k a btich, I followed the rules... Not talkin to her.
Now I get confronted with phone records.... well she attempted to call me over 150 times in less than a month. Left only 7 messages. This is where my cell phone and legal hate is coming into play. When they confronted me with the records, all the times I ignored her call and did not answer would show up as like a 2 second call between us, the courts say that is fine... However the times she left a message says there is like a 3 or 4 minute conversation (it just shows 'call from her number' - 'call recieved by my number') even though I was not answering. They are saying this is a problem. They are saying that a 4 minute phone record is considered having contact with her.
Until today, I thought it was not a big deal, I saved all of the messages she sent and have been re-playing them daily. I have court tomorrow and went to check my messages today... and the cell phone tells me "all messages from previous inbox session have been deleted"... The phone company reformatted their way of handling their voice-mail messaging system TODAY!!!
All my saved messages for proof that it was her just leaving messages is gone.
My condition for breaking the No contact with her claim is a possible 60 days in lock up.... Am I screwed? what can I do? Calloed customer support with my cell and they said the messages cannot be recovered... Only other person ever to hear the messages is my girlfriend... not a valuable witness in this...
Think I am screwed? or am I just over-reacting and worried about nothing... any help or advice? come on legal junkies... help me out.. sorry for the long post
