Why are you asking a bunch of kids on a website mainly geared for audio(granted its the OT section) about this instead of your attorney?






How many times in a week are we gonna get this same "I need legal advice" BS? If you have a legal question and for some odd reason don't have or don't want to talk to your attorney then try a website geared toward law.

I don't get it. You should be able to fly by just fine. You have a witness that heard the messages and just have her confess that you haven't talked to her at all if she is really sorry? Why wouldn't she just tell them that you've never talked if you really haven't.

the phone records wouldnt of really helped, since when somebody leaves a voicemail, the minutes start when the ringing stops. and when you look at phone records it doesnt state whether the person answered the phone, or a voicemail was sent. it will just show the time after the ringing had stopped until she hung up the phone after leaving the message. let me know if you dont know what im saying.

well guys, first off, for people hating that I asked people at a car audio forum.... it's kinda simple, it was night before court and I didn't want to go through all the time of signing up on a new forum (giving my email adress, filling out the registration forum, back into my email to verify and all that crap), plus nobody ever said this forum was 100% idiots... Yess probably 99% tho.

Results from court: Well I am here... but I got eaten alive about not saving my recordings to another/safer place and then for not bringing my one witness to the messages (girlfriend). They told me they are 'further investigating' it and that my actions were 'suspicious'... Looks like they were really trying to scare me into admitting to something that wasn't true by throwing phone records in my face.

As far as the assault, well I gave an exact account of everything I was going through and doing that night and how I was not involved in any way... Afterwards my lawyer said it went well and yesterday afternoon he called to tell me the assault will most likely be dropped within the next month!

I forgot to mention, I have close to 150 text messages from her however, where I haven't replied to any; but police seem to think less of text messages from what they could have actually heard.. Her text messages range from "she is sorry she did it" to "I hate you and Im gonna do it again if u dont talk to me".... these are on record... Police actually took my phone the original day I was arrested and were recording her text messages to me. They said it's harder for them to prove she typed those messages as opposed to if I had the voice messages, they can prove much easier if it's her voice. Only reason she has not been arrested so far!

yessir... apparently one of the better lawyers from where I live. But he did not even hear the messages, and I told him I had the messages saved and now I have to go there tomorrow and tell him what happened... Hopefully he really is a great lawyer.

I know this is all over and everything, but wouldnt it have made sense to change your number? even now, wouldnt it still make sense? Or, play the messages into some kind of recording device?

Changing your number sounds like a good option. That way it really proves that you want nothing to do with her. Ends that suspicion that the police seem to have with you.

agreed and yes, best solution. Police have even suggested that. Problem is, it's all happening from my work cell phone.... and although I'm willing to pay the small fee to have a number change and even give the money right to my work to do it, they usually don't like having these things happen... 1.) this country is fked, yes, but someone cant say "he assaulted me" and you have to go to court for it. there has to be either an eyeball witness, marks from an assault or some other evidence to incriminate you. if this wasnt true, i could walk outside to my neighbor i dont like, say he assaulted me, and have him taken to court.

2.) the situation you're in now... i would call the phone company and have them held liable. speak to the highest person you can immediately, ignore front-level reps. get a sup or manager and explain to them the situation and have them forward you a signed statement saying that they deleted your voicemails which were your evidence in court.

3.) fk the police. i hate them, with a passion.

you can press chrges against someone without a witness present

if its a case that the da finds frivolous, he probably wont actually press the charges ghowever..

but if she shows up to the cops, with bruises, and they dont catch her in a lie, then yeah, youll probably have to go to court

definately speak with a lawyer about if..

if that fails, and you win in court, you may talk with the police about having her charged with filing a false report as well, but that will be the officers discretion
