Cops, lawyers: i need legal help in PA

yes but there is an or in your statement. she may not have been paying attention which means she may have had plenty of space between her and the other car.
To me that means she was not following too closely. she just wasn't paying attention.//content.invisioncic.com/y282845/emoticons/confused.gif.e820e0216602db4765798ac39d28caa9.gif
Right so maybe she can get a ticket for too close but who says anything about a ticket for not paying attention?

the point is that you don't have to be "following too close" to get in an accident. how do they know she was or was not following too close? and why would they have a mandatory ticket if there are other causes for a collision?

you can get into a rear end accident without following closely
yes you can but then the ticket is failure to maintain control of your vehicle.

in pa any accident where you hit the rear of the vehicle in front of you is your fault... now way around it! only way its not is if that person backed into you!

be glad she didn't get any other tickets i.e. careless driving, reckless endangerment, careless disreguard, failure to maintain control

nothing major. my gf just got into a car accident this morning. it was just a fender bender but it was her fault, she rear ended some old lady. anyways, the cop that came to the scene wrote her a ticket for following too closely. he said its manditory for all rear end accidents. that sounds like a load of bullshit to me. anyone know whether or not this claim is valid? as if being in an accident and having your insurance get jacked up isnt punishment enough, this ******* cop decides to write her a fvcking ticket.
Look at the bright side, at least someone didnt put a ram into her rear end.

They could have ticked for "failure to maintain control of a vehicle" (she could not stop the vehicle before she crashed) or "excessive speed" (she was going to fast to stop but they would probably need skid marks) or "inattentive driving" (not paying attention to the cars around her)

was she drafting the old lady to save gas?
