Cop punches girl after pepperspraying himself. excessive or not?

He still has a duty as an officer to let her know the law. She shouldn't be riding her bike on the sidewalk. Plain and simple. If she wouldn't have gone all ghetto on him, he may have just said "please ride on the street or walk your bike on the sidewalk"
I've had cops give me TONS of crap over riding my bike. Hell I had a cop "pull me over" once while carrying my bike on a sidewalk sideways (across my back) and said I was taking up too much space on the sidewalk and people could not get around me easily. Was I mad? You bet. Did I do what I was asked, yep. Whats the point of fighting the situation?

If he really wanted to be a dick he could have given her a ticket for improper safety equipment (no flashing lights, no front light, etc). Hell in my township you have to have a license on your bike (a small flexi band with a number on it) and you can be given a 25 dollar ticket for not having it.

The cop didn't make those rules, he is just enforcing them.
A punch is not an enforcement of laws. The police DO NOT issue punishment. The police DO make the judiciary aware that a citizen broke the law.

No you don't have to abide the law. In fact you have a duty to break any law you feel is unfair or unjust, or being applied against the true spirit of the law. It is how you do break it that matters.

Being an officer you also must be mindful of your actions at ALL times. He clearly got riled up about him spraying himself and clearly took the frustration out on her. He is just as much of an idiot as the woman on the bike.

Sigh...what was she doing riding in those weather conditions period. If it is not safe to ride your bike on the road where it is supposed to be ridden then dont ride it. It was dark and foggy, obviously not good bike riding conditions.

If its not safe to drive a car on the street due to weather conditions you are now allowed to drive it on the sidewalk.

Sorry it should have said "maybe she was intoxicated, or she had warrents out ect.."

And thats where it comes into, why was he pulling her over? What was his motivation? Any reasonable person would know why she was riding on the sidewalk and not in the street. One could say that the cop's intention was to fuck up someone's day.

The fact that she was acting criminally does not give the police the power to respond with force.
Flip, you know better than to respond without reading all replies. No where in my replies have I said he had the right to respond in that manner. In fact I have stated what you just said, a few times now.

However the coin goes both ways. just because he responded with force, it doesn't negate her actions either. They are both guilty.

Based on that media clip and his dash cam, you do not get a full story at all.

Oh and i ment end of story with the whole cops dont have a right to treat her the way they did on the ground ect....the whole OC spray thing im still very curious about to why it happened.

Truth, while she was in handcuffs on the ground the three cops had a rough time managing her, that's why it was necessary to punch her, kick her and step on her throat...maybe they should've just shot her in the leg or arm a few times to shut her up...

Let's just be realistic here, what happened is the officer was embarrassed that he pepper sprayed himself, and took his anger out on the woman. He should be in prison.

It did go way overboard. He should have not hit her. Obviously, if she was able to talk while being hit, he wasn't much of a boxer. If I'm punching someone with their face on the ground, they wouldn't be talking.

I'm not saying his actions were correct. All I'm saying is that if she would have just gotten off the bike, listened and explained NONE of this would have happened.

Goes back to the thug attitude I mentioned earlier. For some reason thugs think that they are either above the law or that the law is just trying to focus on them. I'm about as Johnny American as it gets and the police have stopped me before. Were they racially profiling an upper middle class white guy? LOL.....of course not, they just were curious what i was doing. Not a big deal at all. If I was a poor black guy though in the exact spot it would be profiling. Meh

How about letting the punishment fit the crime? Many people don't spend time in prison for a simple assault. He definitely needs to lose his job and the capacity to hold job as officer in the future. True. He was mad that he sprayed himself. It wasnt that she was resisting, he was even part of the "arrest: the other two officers had it, he was off to the side licking he wounds....got mad, walked over and punched the girl. Then slapped her again while she was sitting handcuffed. His anger got to him.

Put up with what? the fact she was stupid and was riding her bike in the dark\fog on a sidewalk? or the fact the officer for some reason decided to stop her (she had warrents he may have known her) Or are you not going to put up with the fact she did not comply with the officer and then resisted arrest?

That is irrelevant. His possible mal intent doesn't give her the right to resist.
MLK didn't start pushing officers away when he was carted off in Mississippi when the parade law was applied unjustly against him. He peacefully accepted the arrest.
