Cop punches girl after pepperspraying himself. excessive or not?

You may want to BELIEVE that you are giving up your (my) rights, but they are not there. If a cop tells you to get down for any reason (he deems you a threat) he can take you down. Sure there will be inquiries into the situation but it is his right to do so as a protector of the peace.

It was a generalized statement. I honestly thought you were a mod but was not directing it at you in any way. First off, I would never say a particular mod shows favoritism as that would not fair well for my account LOL secondly I just don't care that much that it happens was just more of a point of reference to this situation.

 
Put up with what? the fact she was stupid and was riding her bike in the dark\fog on a sidewalk? or the fact the officer for some reason decided to stop her (she had warrents he may have known her) Or are you not going to put up with the fact she did not comply with the officer and then resisted arrest?
I am saying......of all the bad and evil shit people do these days.....riding a bicycle should not even be a crime.

How many times have you biked on the road/sidewalk. Were you arrested and hit in the head?

It is not a crime, however sidewalks are for pedestrians and not for cyclists. So riding a bike on a sidewalk is not exactly following the rules.

(She could have also been intoxicated, he knew about her warrents ect.. and i really hope there was more to this story or else im glad i live in canada OC spray for a bike on a sidewalk...)

Agreed, but it still doesn't give her the right to resist. Nor does her resisting give him the right to hit her while she is being subdued.

Nod. I think this is the point of this story. Yes, riding on the sidewalk at that hour is smart. Low traffic on the sidewalks (if any) and a safer ride. All it would have taken is the police pulling her over and her saying "its dark, and I don't feel safe riding on the street"

the cop was just doing his job. He probably thought the bike was stolen considering she was black.

He still has a duty as an officer to let her know the law. She shouldn't be riding her bike on the sidewalk. Plain and simple. If she wouldn't have gone all ghetto on him, he may have just said "please ride on the street or walk your bike on the sidewalk"

I've had cops give me TONS of crap over riding my bike. Hell I had a cop "pull me over" once while carrying my bike on a sidewalk sideways (across my back) and said I was taking up too much space on the sidewalk and people could not get around me easily. Was I mad? You bet. Did I do what I was asked, yep. Whats the point of fighting the situation?

If he really wanted to be a dick he could have given her a ticket for improper safety equipment (no flashing lights, no front light, etc). Hell in my township you have to have a license on your bike (a small flexi band with a number on it) and you can be given a 25 dollar ticket for not having it.

The cop didn't make those rules, he is just enforcing them.

That is irrelevant. His possible mal intent doesn't give her the right to resist.

MLK didn't start pushing officers away when he was carted off in Mississippi when the parade law was applied unjustly against him. He peacefully accepted the arrest.

She was acting criminally. Nothing you have said proves or shows she wasn't.
