Hahahaha. To give the man SOME credit he said he'll make a decision by tomorrow. ? So I don't know what "decision" hes making. I guess one that is to delay the cash return or to return the cash now...? Am I wrong? rofflecopterwaffletofflesauce.

Well first off that will never make it to court. If it does, its not like you can really sue him for anything more than the cost of the thing. Did you pay through paypal? You can normally get something that way. Otherwise contact the police.

WELL I WAS JUST TRINg TO STATE THAT IT IS NOT WORTH IT not to pay back the money..thats all...dont take everything so seriously:)

Ya can't say you have a ripe apple when you know dam well its rotten... legal action COULD be taken - but hopefully he'll just give your $ back.

 
go to paypal, hell go to visa and tell them that the guy sold you defective product, you have the product to proove it. one phone call to visa with his address\name will straighten things out. visa dosnt **** around when it comes to fraud and their creditcard holders.

paypal will actually contact the seller and visa and handle it all for you. i dont think their is a fee eaither. if he took your money for broken shit that he sold you, its very simple to get the $ back. just contact the credit card company or put a 'stolen money report' through paypal. just send them the pictures + logfile and they will 'investigate'.

in this case, its very easy to get your $ back. if it were a MO then you would be shit out of luck.

so call your creditcard company, and contatct PAYPAL ASAP! dont sit and wait for his decision, call them now, tell HIM you called them and they are investigating, and if he dosnt give your money back - the credit card company WILL - and thats not good.

I know that when I sent the subs they were not in that condition. I really appreciate the way that my name has been dragged through the mud even before me and the buyer have had a chance to ultimatley decide what needs to be done. I also appreciate the way that everyone seems to think that there's only one side to every story and is on my back about this. If you ask anyone that has ever done business with me before in the past, they will have nothing but good things to say about me. Now because of this unfortunate incodent my ability to buy or sell used gear is shot to ****.

I just wanted to say that I have done a transaction with Darren in person, and there was absolutely no problem. I have also spoken with him on the phone many times since then, and doesn't seem to me like the type to rip anyone off. He did mention to me that the subs were packed by the UPS store, so I don't know if that had anything to do with it. From the pics that mjbailey posted, if you look closely, it seems as though where the tears in the surround are, there are perfectly straight "slits" (from a knife or blade) in it. I do not know whether these were there or not before, but from the pics Darren posted, it's hard to see anything of that nature.

Being a frequent shipper at UPS myself, I have seen some of my stuff handled with...well...not the greatest care in the world, and I do also know that they usually put everything in the box, before they cut the box down to size..which could explain the "slits" in the surround. Again, I don't KNOW if this is what happend, but I just don't want to see someone hung out to dry, before all the facts can be gathered.

MjBailey...I'm really sorry you didn't get what was described to you, but there is the possiblilty of poor service on UPS's part....and I'm sure Darren will get this straightened out with you either way.

from what ive read, i seem to have missed the fact about them being shipped by UPS. why did you not package them yourself?

im confused as to why you would let them package the speakers anyway.

as tim (tplaya) said, they usually put everything in the box to make sure it fits, the prolly stacked the subs on top of each other (cone\mag\cone\mag\cone\mag) and ripped the two bottom cones apart without realizing what they did.

how were they packaged in the box when you got them mj? were they wrapped individually and on top of each other, or was the cone facing the side of the box. this is most likely a UPS shipping issue.

I dropped the box off at UPS and paid the shipping expense. I did not see how they packed the box or how they treated the subs when they were moving them around. Seeing as UPS picks up the insurance on any packages valued at $100 or less, I think me and the buyer need to file a claim with UPS. This will be the last time I ever let them pack anything for me.

 
Ok, I handled this in a very immature fashion and I do what to partly apologize to DarrenE. Although I have not recieved any cash back yet, I came straight to these forums after he said that I had seen the pictures and agreed. I felt he was just trying to scam me and I took action too quickly. I was worried because these are not so much for me as for my friend who cannot really afford a whole lot of things. He is an only child without a father and a great kid in school and does a lot for the community when hes not working for minimum wage to help his mom. This isnt a story to get more people on my side, I was just looking forward to doing him a small favor. (He had been saving some money up for an amp and other stuff). Regardless I didnt want to lose money on some broke *** subs.

Darren got back to me today and is filing a claim from UPS for the damage. Either way he is trying to work with me for now. I did not neccesarily hop on these forums and post to make him look like a complete *** and dishonest man, but I was upset and I do know it came out like that (no lie, there problem was some intentions of that). But like the title said, I was really just asking on opinions of what procedure to take towards getting my cash back. Good day- Matt

 
I recently re-read this thread, and found out more information. After talking to Darren online, I realized that this is probably another UPS tradegey. Sorry.

I told Darren to keep it up with the claim, as the subs are now broken, it would be covered under UPS policy to refund their money.
