You may be able to fix it, assuming that mother ****er doesn't give you your money back. Just silicon it very carefully and generously. May not be as good as new, but would hopefully work.

Well first off that will never make it to court. If it does, its not like you can really sue him for anything more than the cost of the thing. Did you pay through paypal? You can normally get something that way. Otherwise contact the police.
