Dispute the second charges only. He doesn't have much of a leg to stand on. Even if he did it is hardly worth him putting a retainer down on to get sorted out. He is more than likely blowing smoke up your ***.

 
He's totally bullshitting you. I went through this same ****ing bullshit with him. I remembered calling somebody in Utah (goverment) and asking them about sales tax. Even though they couldn't help me out I made up some b/s that they did. I told them that his own government told me that the only sales tax charged over the internet is state sales. I never paid the sales tax with him! I fought him like "a littel kid" and in the end I won.

*He never told me shit. Didn't reply to my email.

LOL look what I found some old emails he sent me about sales tax that I posted up in the old forums I was subscribed too...

Mr. Rodriguez, I don't know if someone has contacted you from our company as of yet, but we have a small problem. The accounting department has sent me an email and stated they have not charged a $208.11 sales tax on your order. I'm not sure if you read through our payment description carefully or not, but all of them clearly mention that we charge a sales tax on every order. I talked to the main boss to see if we could waive the sales tax on your order, and he stated we just recieved a letter from the Utah state government requiring that sales tax is charged on all internet and local sales. We could get into a lot of trouble and be fined if we sold these items to you without paying sales tax on them at the end of the year. This is why we mention it in all of our payment descriptions. They mention its against the law for companies not to charge a tax in the state of where the items are purchased or not to charge in the state of where the items are recieved, one of them need to charge or else items are being sold with no tax on them. I can't express how sorry I am for this inconvienence, and I have tried to talk to him and see if we could waive it. We will need the $208.11 paid before the rims can ship out. Please send it in a money order to our address. Let me know if you have any questions. If you already paid the sales tax seperately, please disregard this notice. So far we have record of you paying the $2599 sale price and $274 FedEx shipping. The big boss stated that if you decide to purchase your tires from our company later, then we will definately give you a considerable discount for this inconvienence. My company already finds tires for our customers for "our cost", but we will end up paying for part of the tire price for you. Thank you for understanding about the situation. Al Peters.

if you buy something from a DEALER, in texas and he has sales tax's in texas and you live in new mexico you dont pay those tax's unless he has a sale's title in that state then he can charge you... thats it i didnt wanna read it all so it ends on page 2 for me

 
Another email I got back then from them...

We assume you read all of the details and the tax goes to the government not our company. Its pretty foolish to think that a sales tax is waived or not included into an order. Unless you are tax exempt, a company legally cannot waive sales tax on an order. Please remember we pay a sales tax on these rims when we purchase them from our distributor.

Please don't think that we are trying to pull "a fast one" on you. My company does not make a penny on you paying sales tax, it all goes to the state of Utah and if you would like, I can show you a print out of our tax report at the end of the year which shows we paid the sales tax on your specific order.

If you have any complaints that you feel that you should not have to pay sales tax, then you need to call the tax commision and take that up with them and explain to them why they shouldn't charge you sales tax, please leave my company out of it.

Another email...

If you are planning on cancelling your order, they will charge a $595 cancellation fee for the 24" rims being already drilled. This policy has been active for 10 years and is charged to the customer. My company will also have to charge you the shipping costs of sending the rims back to the manufacturer, and I will need to get a quote to see how much its going to cost us to send the 5 boxes back to them. It is company policy that the customer is responsible for all these fee's and charges if they choose to cancel an order. We definately loose a much larger amount of money then the small price you pay for the cancellation fee because the rims cannot be resold. Thanks LM

 
Here's what a Goped dealer told me. These guys are from Salt Lake City,Utah.

Sounds like they are trying to rip you off. If items are shipped out of state, sales tax should not be charged.

I'll bet you he has a little scam going, charges out of state customers sales tax, and then pockets the cash. That's what I think

"Please remember we pay a sales tax on these rims when we purchase them from our distributor." -- This is an outright lie.

For this reason, whether it is a regular online sale, or ebay, or whatever, I do not recommend money orders. Once you send it, you're out the money, and you have no recourse. With a credit card or PayPal payment you can do something if the other party tries to pull a fast one on you.

I recommend you request them to return the money order and buy them somewhere else... But since you already sent the money order, you have very little power... you might just want to pay the "tax," lick your wounds and be smarter next time.

 
And yet another email from the guys from Salt Lake City...

Legally, all sales must be taxed in the destination state. For example, if you live in Oklahoma, and you order something over the internet from New Jersey, the store you order from is required to collect sales tax at the Oklahoma rate and forward the tax to the state of Oklahoma.

Trouble is: most states don't actively enforce this "use tax", as it is known, (because it would be WAY too difficult for a state to try and audit every single business in the country who might have shipped products to that state) and thus the perception is that out of state sales are 'tax free'.
