Yesterday I emailed him and told him he was an idiot for telling me:

a) I had to obey by the eBay rules even though the transaction was not made via eBay

b) His auction is stating I have to pay him tax if the rims are shipped to Utah, but they weren't

Raisedin305 emailed him saying basically that he referred me and to remember when he tried to pull the same thing on him, but wound up not charging him the tax afterall and to do the same so he doesn't look bad.

He sent me an email (this guy's a real *******, since day 1) basically telling me about his top of the line lawyer [he always brags about his huge house and big lawyers] and that I've been a baby since day 1 with his company. He promised me they'd be shipped out the Friday I ordered them, so the spinners he gave me a tracking number on that Friday and said they were shipped... and the rims no tracking number. The tracking number for the spinners said they weren't picked up until that Monday and the rims weren't shipped until the following Tuesday. I told him that was bull and he should've told me the truth that they weren't shipped yet. He yelled and yelled and I just basically took it.

Here's the email after Raisedin emailed him:

Look at it anyway you want. If I was "genious" enough to put in our ebay auctions "sales tax will be added to your order" and then plan for you not to read it and happen to not see it and then be contacted from accounting stating that you paid for the order and they forgot to add sales tax, then it must be "planned" right Kenny. And you call me the stupid one?? Think about it my 15 year old friend. Call my attorney bull crap or what ever you want, the cold hard truth with hit you clean in the face when you realize the situation you got yourself in by disobeying a law writting policy with the local state government. Don't forget that this isn't for me, this isn't our money, we don't make a profit, you seem to forget this is for paying the government tax on items we sell. We claim the tax. Fact is, you didn't read the payment description, and you are know coming to grips with this error on your behalf. Honestly my boss is a dick, and he actually enjoys when customers "doubt him" and give him the oprotunity to flex his high class attorney's to make him all the restitution and money back on this case, its a definately a benefit for him. So keep up your doubting, and the truth will soon be revealed, and I will do nothing but laugh. You won't be reciving the bolt/ nut, warranty or anything until we know that the sales tax is paid. NO other way around it. Your "ghost" attorney obviously doesn't know the law and is talking straight crap, and thats assuming you weren't lying and actually talked with one. If we didn't have the authority to charge tax, then all of the court cases and Judges must of been wrong on their previously descisions with other cases, right smart ***?? Ask you friend Ernesto why he paid sales tax on his order and had no problem doing so. and didn't cry and whyne like a little 11 year old to my company. I told him that you are the biggest crying baby we have dealt with in all the years we've been open and he never should of refered you to our company because you have wasted our time and have been the oposite of a true man!! Basically a coward kid who has some growing up to do. We have been charging sales tax on orders for years, because we claim everything on our quarterly taxes and we pay those taxes for each sale. Not to mention, we have to pay a sales tax to our rim distributor when we purchase your rims, and thus another reason we charge tax and mention it clearly on ebay. We actually end up almost paying twice taxes, isn't that wierd?? Anyways, I told your friend Ernesto, that it has been a nightmare ever since day one when you contacted my company. You are free to cancel your order and return your items, but you will be subject to the 40% restocking/cancellation fee charged by the rim manufacturer which is nothing to do with my company. You are free to fight them in court with your attorney as well. I'm done talking with you. I "challenge" you to dispute those charges, and we will have a great time taking you on the "doubting" court case of your life. When growing at age 15, you can call this one of your learning lessons of life, and maybe you should take some people serious. I definately want to be the one who shows this lesson of life to you. When you want your warranty and bolts, we will need confirmation of sales tax agreed to be paid. Tahnks

Anyone wanna help come up with a witty reply? I'm disputing the charge no matter what, I just rather not have to go to court over it.

 
I know they are trying to change it, but if you're not in the same state you shouldnt have to pay.......I don't think.

Just read your last post. How much is sales tax? I mean at 6% you're talkin about $80, no legit, "ballin" business owner is gonna waste their time with a customer about some crap like this, especially if they foked up.

 
That's what I figured too, and his auction says IF shipped to Utah. I just replied to his email with this:

I did not purchase from your eBay auction, so can you please explain to me how I'm subject to your auction terms?

 

If I was subject to your eBay auction's agreement, your auction states there is 6.6% sales tax IF SHIPPED TO UTAH. I do not live in Utah, I live in Florida.

 

If you want to go ahead and claim that I should follow the auction's details, well, then I'm subject to a 100% satisfaction guarantee or my money back. I'm not satisfied with the manner in which I'm being treated, so I'd like a full refund like it states and you said you'll pay for them to be removed from my car and shipped to you, right? It says "covers all expenses."

 

I specifically asked dude, specifically, just so this wouldn't happen before I handed my credit card number to you, "So, $1,399 + $194 is all it's going to cost me, right?" to which you replied "Correct." I don't see how you can try and charge additional after that.

 

I'll pay your tax like your auction states, but then I would like a full refund like your auction states as well.

You arent really going to pay the tax and get a refund are you? Just dispute the charge if he charges it and forget about it, also do what the other person said and tell your CC company not to allow any new charges for the time being.

 
I would tell him that you are going to contact the bad buisness burior and then I would call the local one in his area and tell them about it and emails let them contact him about it and see how fast sht changes.

 
I would also go as far as contacting the news stations in that area. Tell them what happend, around here we have something called new on your side or some sht when companys pull this type of sht you contact them and they get ahold of the company ask them the Q's and post it on the news I am sure he wouldnt be happy about that as well.

You need to scare him now, he called you out about being 15 he figures he has you by the ballz your to young to know things like that to get him in trouble.
