Yelling FIRE in a crowded theater is NOT free speech and is not protected by the first amendment. When a person yells FIRE in a crowded theater it is to incite fear and cause panic. This can and has led to personal injury and death. It actually falls into the category of terrorism. Now, shut the hell up about it, you are wrong.
It most certainly is. You can also whisper it, say it in ASL, or in a "normal" voice. It has been done plenty of times by people who have not even gotten in trouble for it. But I'm sure some have done it and HAVE gotten in trouble. You are obviously confused between what is a protected right and what is legal.
Free speech is your right, protected by the First Amendment. That freedom does not give you impunity from what can happen if you exercise it improperly, however.
The right to bear arms is protected by the 2nd Amendment. It is a RIGHT. Now, go ahead and open carry in Manhattan without a permit. See how it goes.
Does that mean you don't have the RIGHT to bear arms? No. But exercising the RIGHT may violate a state or local law. Just like exercising the RIGHT to free speech may violate state law.
