Nothing wrong with prenups imo, especially for people like yourself perhaps. Wouldn't/didn't consider using it myself. However it is well established that we are different animals. What doesn't work for me may take a great burden from you.

If the trap I setup is in the open where privacy is not to be expected, then yes it carries less deception than unauthorized access to private communications.

Hmmmm... I think the police (total strangers) tapping the phone is considerably different your life partner. There should be no secrets in a marriage thus right to privacy doesn't exist... if there are no secrets there is no need for privacy

Well, that is tricky for me as well. Bringing it up implies a fear that the relationship will indeed end. Even though that is a practical concern, females are not known for being practical. This creates a demand for alternative measures...a synthetic pre-nup, if you will.

I disagree. Privacy doesn't go away because you married someone. That is a ridiculous thought. Individuality can be maintain in a healthy relationship. So your logic is skewed too. My wife should be able to talk to friends of hers in confidence of privacy to help her in venting, as do I. Why break the trust? I have never even thought twice about breaking my wifes trust and snooping her shit, but then again I have never been given a reason to, so I can't say exactly what I would do.
