If Florida has a no fault law like Michigan, you won't be able to sue him. The point of insurance is to pay for damages. You'll probably end up fighting his insurance company for medical expenses and loss of work.

Also, why do people get so worked up over their cars? It's not like he ran over your mother.

Oh, shit! Fusion's in FL.

Yeah, dude. We have crap laws here. You won't get a dime more than it takes to replace your car and minimal reparations for loss of work. Just hope your employer doesn't fire you.

And in that picture you have in your sig, Fusion, the car actually looks worth a damn. Like if it was a real car or something. Crazy, I know.

Mandatory CoveragesPersonal Injury Protection (PIP)

The Florida Motor Vehicle No-Fault law requires owners or registrants of motor

vehicles to maintain personal injury protection (PIP) coverage at all times.

71

A

personal injury protection policy pays up to $10,000

72

without regard to fault for

bodily injury sustained in a motor vehicle accident by the named insured, relatives

residing in the same household, persons operating the insured motor vehicle,

passengers in the insured motor vehicle, and persons struck by the insured motor

vehicle. The coverage also extends to children who suffer an injury while riding a

school bus. The amount paid is:

• 80 percent of all reasonable expenses for medically necessary medical

services;

• 60 percent of disability benefits for any loss of gross income and earning

capacity per individual from inability to work proximately caused by the

injury in the auto accident;

• 100 percent of replacement services (e.g., child care, housekeeping, and

yard work), and

• A $5,000 per individual death benefit.

The owner, registrant, operator, or occupant of the PIP-insured vehicle is immune

from tort actions (and, conversely, may not bring suit to recover damages) for

pain, suffering, mental anguish, and inconvenience arising out of the accident

except in cases of:

(1) Significant and permanent loss of an important bodily function;

(2) Permanent injury within a reasonable degree of medical probability, other

than scarring or disfigurement;

(3) Significant and permanent scarring or disfigurement; or

(4) Death.

Florida does have a similar no fault law.

In Florida, if you are rear ended, it's entirely at fault to the person that hit you.
Yes but you cannot sue him since he is insured. That's why it's called no fault. If you are dead or disfigured yes. I just posted your state's law. You will need to fight his insurance company for loss of wages but you aren't going to get a big settlement.

wait u got all that shit set up to start geting money each week. i got in to an accident i have a transverse Fx in my back. im out of work for at least another 2 months or so. im still tryin to get money for my car/outof work. i have not heard shit from my lawyer im out of work with no money nor do i have a car. im sorry to here about your injurys bro . im sure u will get a new honda or what ever u want. all will be good for ya.

Loss waiges are covered by my insurance company. A rental car is covered by the guy's insurance company until I'm cut a check for my car, which will probably be about 2-3 weeks.

My insurance is paying for hospital bills up to X amount, and that's when the other insurance company takes over the difference.

When I said "lawsuit" I meant we're going after his insurance company for whatever they try to dick me out of.

Like I said, I honestly don't care about coming out with $10-$20,000. All I want is my car to be replaced and all costs and fees to be covered. If I come out with money in my pocket, that's a bonus and not what's entirely important to me.

Yea you won't get cash out of him. Insurance companies aren't going to pay out huge settlements. They have lawyers and it maybe in your best interest to recover enough for your damages and move on.
