i didnt read most of the thread, but the OP is a moron if he even thinks he has any legal recourse

car was 5 feet away from house, if alarm was armed it would have gone off, we would have woken up, it's loud.

how hard would it be for you to press the alarm button when she handed back the keys to make sure it was locked and armed?

sounds to me like your the dumbass that messed up by not checking your car and are trying to throw blame elsewhere
