I read the ToS, and therefore know that because of them, any court seeing the case will rule in favor of the owner because the ToS says they have to.

What I'm telling you is that the rules here aren't thought about and kept inside Goob's or the moderators' heads. They have to be written for them to be real. Considering the ToS or classifieds rules haven't been updated today by Goob to outlaw tobacco pipes(because, SM, that's what they are. Remember that fallacy I told you about), I don't see how it was against any rule.

If you, or anyone here, has fully read the ToS from beginning to end, they know it's literally impossible to try to do anything about anything on the site. SM, if you want to argue semantics, argue with law enforcement agencies, or the DEA, or the federal government. They're the ones who say pipes and water pipes are legal, while bongs are not. It doesn't matter what you or I think the person buying them is going to use them for. They're tobacco pipes.

Very good point but Goob still has the right, at any time he sees fit, to change, modify or add any rules with out any notice. He is not legally obligated to do so with his private property.

Now if that is right or wrong form a morality sense is a whole different thing.

He doesn't have to force every member to re-read the rules or ToS, but he does need to add them. Not adding them makes them invalid.
