Taking my Ex-Boss to court?

I'd get a lawyer. Did your boss lay you off indefinitely, or just till your healed up? If he laid you off permanently, you can sue him for damages for him illegally firing you (he'd be trying to shove you under the table so he doesn't have to pay for your injuries). If it's only temporary you most likely still qualify for some kind of workmans comp pay while you heal.

My ex-fiance's brother went through this same kind of b-s. He was working as a groundskeeper for an apartment complex and fell on a nail sticking up in the floor while he was re-carpeting an apartment and it stabbed him through his knee behind his kneecap. They fired him and told him he was responsible for his own doctor fees because of 'self neglegence'. The dude got a lawyer and sued. They ended up having to pay him 15k in damages and all of his surgery bills cause he had to have a pin put in. I think they also had to reimburse him for rent because part of his employment also included living on the premesis of the apartment and they kicked him out, but that's circumstantial.

They can't pull that crap about not going to their preffered doctor though, that's why your allowed to get a second opinion.

 
There are forums with lawyers on them that will give basic advice just to be nice guys. I would take it with a grain of salt though, and see if they look like a reputable source of information.
The things with lawyers is they charge you money for everything. If you call them they will charge you by the hour... I should have done better in school.
Yeah but most lawyers dealing with a lawsuit case like this won't charge you till the suit is over, and they take it out of the payout if you are awarded money. Atleast that's how I understand it, never sued anyone.

 
I got laid off about a month ago.. but a month before i got laid off.. i fell 14 feet and went to the ER to get X-rays... weeks later i get a bill worth 2k i gave it to my boss.. he told me sense i didn't go to the DR that they assign everyone to go to when they get hurt on the job that he will NOT pay my bill... but its workmans comp shit.. if i get injured on his job hes suppose to pay isn't he.. their DR not open at 8PM at night.. because when i got off work i had to go 45 minutes to my Work office to field out a injury report for the company by the time i got home it was late.. and was hurting bad... but its been almost 3 months now... ive sent him all the bills ive got and everything.. hes not doing anything... Can i take him to court and win this pretty easy.. i don't want him to just pay it.. i want something out of this.. if i gotta go thru the trouble of having to get a lawyer and paying Court Fee's... What do you guys think?'


BTW i know for a fact this guy has millions and millions of dollars.. lol
Why didn't you go to a doctor the following day? At least you would have been on another record as getting hurt on the job.

You're ****ed and he can probably sue you for everything you have.

That's actually incorrect. In workers' comp the fee is typically set by statute and the lawyers do not charge by the hour. Besides, most lawyers who represent "hurt people" will give a free consultation.

OP, in some (most?) states the worker has his choice of physician. The employer can require the employee to be examined by it's physician, but that does not prevent the employee from seeking medical treatment from his own doctor. (there are limits on when the employee can jump from one doctor to the other though).

Call the worker's compensation commission, my guess is that they tell you that your employer is full of shit. In any case, they will give you more help than you will find here. And don't be afraid to get legal advice from a lawyer.

I broke my hand and didn't go to the doctor for 3 days, because I figured it was just sprained.

I wasn't talking about workmans comp.

My mom was in a car accident like 3 years ago, and the stupid thing is still in the court system. Every time she calls her lawyer they add that to the amount they collect when it's over. Needless to say she doesn't call them very often.

H*ll yeah, this mexican I worked with broke his wrist, he didnt go to the doctor until a week later. That was framming houses too, so he had to use that wrist almost 100% of the time, he really loved his job.

Last summer I pinched a nerve in my spine on the job and that's what happened. Boss let me just go home, but the next day I couldn't even sit up to get outta bed cause the muscles swelled a bunch while I slept. I just went to a doctor and let my own insurance cover it though, didn't have to deal with the crap the op is thankfully.
