some help for sound violation tickets

hey, a friend of mine almost got popped for a sound ordinance violation, lucky for him, he's in school to be a lawyer..

here's some advice he gave that helped him get out of the ticket..

1) check your local laws, know exactly what they say

2) if pulled over, don't argue. make known the fact that you are going to contest the violation, politely

3) ask how loud you were. " i could hear you 50 feet away" is almost certainly a "dismissal" it's on the state/county/city/township to prove how far away they were...and they have to be able to prove it.

4) if they do conduct a sound metering test, make sure the meter has been calibrated within a year(

5) being heard fifty feet away isn't against the law, as talking can be heard from fifty feet. there as to be a minimum db that constitutes the sound violation. did you break that minimum? don't use test tones or burned cd's above 128kps.

6) did you break the minimum? don't get worried yet. now you have them on discrimination, on the grounds of youth (most people who get pulled over for this are under the cop's age, and are probably a minor) and/or ,in my friends terminology, prejudice. why prejudice? have them test a harley (or any bike with no baffles), a car with flowmasters(or loud pipes period), a neighbor's lawnmower(make it an old crusty one,lol). see how loud they are at 50 feet. chances are at least one of them will be as loud, if not louder then you(especially if you are in a trunk car).

7) now do some research.....how many harley's (or any other type of motor vehicle)have been pulled over for the same violation? it's a matter of public record, so getting the files will be simple. might cost you a litte money, but to prove a point and /or save your audio equipment, it's should be worth it. chances are slim that you'll find any. now see how many violations have been issued for car stereo's. there will probably be more of these. now you see the discrimination based on prejudice? (has almost nothing to do with a person's color, though in an extreme case, that could be used as well) the police were prejudiced against your stereo..especially since most cops own a harley, hot rod or have a friend that does. do you believe they will give themselves, friend or family member the same ticket for their ride?

8) now you have a solid case, if still convicted, you have a civil suit. if you wish to persue it. chances are, if they haven't pulled over people for loud exhaust, tire noise (yep...listen to a set of boggers going down the road) or firing up their lawnmower at 6 am...you'll be let off, more then likely with a warning.

now this isn't a "get off scott free" ticket. you still need to boom responsibly. my friend was pulled over going home from school at 11am (lunch..hehe). he was sitting a intersection from the school to a local highway. no homes, one gas station and easily 1/2 mile (2640 feet) to the actually school facility. he was about 600 feet from the school's new gym/pool house. the cop was leaving the gas station and pulled up behind him. so he was only about 25 feet from him.

so please don't go around at 10 pm thru your kodasack with the system blaring. if you do that, you deserve the ticket.

btw, the friend's car and system?

2004 accord...rActive cat back exhaust, 17" wheels, lowered 3 or 4 inches, small wing on back, big stereoone decal in rear window...8w7 in 2.5ft^3 vented(the box looks that big..hehe, not real for sure), jl 1000/1..loud as hell for what it is.

anyway, i hope this helps....

again, do some research..be responsible and must of all, comsider the financial end of this arguement. it could get costly to fight this fight..weigh your options before you proceed. he was able to do it for free due to his course of study, criminal law. of course alot of you are in college..use the library to it's fullest potential.

Excellent....I posted a thread a few weeks ago about SEMA pushing Legislation to BAN these tickets..It is in fact the Loud Exhausts from cars that are spear heading this new push to stop ticketing motorists based on "PERCEPTION" of loud sytems..IT NEEDS TO BE PROVED NOT "Guestimated" is there contention.

That information is great.....I honestly can see some validity to warning some of us of loud systems because we cannot hear Emrgency vehicles..but at this point it is more of an ATTACK on youth...We all have been harrased and ticketed for the police "Thinking our system is too loud" rather than actually getting busted for Cranking it up in front of front law Enforcment..it is easy for a cop to ticket you even when your system is OFF and then when you try to prove innocence..They see 3000 watss of HIFONICS in your trunk and that is not illegal but makes you "LOOK" guilty...Cops know that and abuse that

I checked into this for IL, and the laws are you can only get a disturbing the peace ticket they have no right to search your car when they pull you over for this because the sound becomes a problem once it leaves the outside of your car,also with that they can not touch any of your audio equipment. I also checked tinted windows in IL are back window and backside windows you can have 100% side front windows 0% and front window you can have like the 1st 6in of the top 100%

true for the state...but u still have to watch for local ordinances...

here in anna (370 miles south of you) if they hear u after 9pm, they wil pull u over and issue a citation..even if ur not in a residental area...

of course, just like i posted above, just mentioning ur going to contest the ticket usually gets u off with a warning...and they won't touch ur equipment here either...what i was referring to there was in ohio, where they are smashing equipment..and in sikeston,mo....where on ur third violation they will confiscate ur entire vehicle, not just the system...

WOW..confiscate your CAR...I do not know the specific laws in L.A. but from what Cops say it's based more on the fear that you cannot hear Fire Engines and Ambulances coming your way if your music is pumping..I do know we have had a few Bad Traffic light accidents that they claim was the result of the Driver Listening to LOUD MUSIC and plowing into a Emergency Vehicle...I am sure they are strict laws though..In L.A. they must issue those tickets like Speeding tickets at the Indy 500..And it's all about the MONEY!!!!

(yes I know that Indy 500 line is from Apocalypse now)

All i can think of is 'what is this world coming to?' when i see people getting tickets for having their stereo up a little bit loud.
