Right to a Speedy Trial

I'm fighting a speeding ticket where I was not speeding. That, however, is not my point.

We all know we have the right to a speedy trial. My question is how is that defined to the court of law? I've heard 45 days, but I can't find any outstanding evidence to prove or disprove that information. Everything more refers to it as case by case. So how would I be able to figure out if I could motion to dismiss based on a right to speedy trial, and that I was denied that right?

 
My lawyer tried the filing of a dismissal for a lack of a speedy trial about 4 times over a year and a half period. It never worked, but the case being drug out so long eventually did //content.invisioncic.com/y282845/emoticons/smile.gif.1ebc41e1811405b213edfc4622c41e27.gif

I'm in Canada (BC) so it's probably a lot different. I did something similar once. I was researching how to beat a ticket and came across some sort of thing about 8 months or so. (It was quite a few years ago and don't fully remember) Anyways it was along the lines of if through no fault of your own, that your court date was not within 8 months you could file a whatever something something and request that your date was not within a certain time and have it thrown out (your right to a fair and speedy trial). When I went to the court house and requested the form, they didn't know exactly what to give me. So they gave me some sort of general form. I filled it out and put in the charter reason as to why I was requesting it to be thrown out. A couple days later I got a phone call saying that I didn't need to go to court and that the ticket was no longer an issue.

 
lol...i don't think a speedy trial applies to traffic courts. When Ive gotten tickets, the trial is always about 6 months from the date of offense. And then if you postpone it, its another 6 months. Im going to court later this month for a ticket i got last year.

 
If that doesn't work either and the ticket is like over $100(depending on the state you live in) you have the right to request a trial by jury. Most judges will throw the ticket out right then and there. If not, well, you will be being judged by a random bunch of people who have probably sped at some point in there life.
