Actually according to OSHA they have to train you and show you said practices. So yes it is on them at first. Dealt with OSHA a lot. If you then disobey said training, and the accident is your fault then of course it is on you that is common sense. But if a machine breaks down and hurts said employee because of a lack of maintenance that the company refused to do or said machine had reports from employees of causing trouble and they ignored it that should be on them. And rightfully so the employee should be able to sue.

However when say in a situation like this that happened up here. And let me mack it clear this came from employees, the company claimed they were doing everything right but too many people said otherwise that worked there. Some even said they were hiding the fact that people were infected.

A Meat Packing company had a few people come down with Covid. Company told no one, so all those people who had worked with them had no clue. Those employees also said that it wasn't as busy as usual which everyone found to be very strange. Within days the plant was shut down then the other plant in town was shut down. By the time it was done the one plant had almost 800 employees down with covid. No one has ever said if anyone died from it.

McConnell wants to stop all that. That is the problem with that protection.

If you've ever received an OSHA 10 or OSHA 30 card, then you know that is hardly training someone to be safe in the field. You watch a couple of videos, watch a power point, and maybe look at a couple of machines outside. I think that you can even do it online now. The virus is a whole new animal. Other than wearing proper PPE, I don’t know what else people could do in a meat packing plant. Wal-Mart just closed two stores here today to get deep cleaned.
 
JEEEsus Christ. People are ******* stupid and because their parents are morons and didn't raise their kids other people have to make sure, that is all they are doing is "making sure" morons are aware when they ignore common sense they will not be held liable for their employees stupidity.

Actually my dad taught that class many times. Mom was the office secretary for that business. What they make you go through for training is a lot more then that at least in classes they did for the Refineries.

No that protection is a "blanket" protection from all lawsuits. That is not right and if you look at other laws wouldn't be legal one bit.

Facts are the business has to train you properly, show you the proper way. If the employee doesn't follow the training to a T. Yep it is on them. But if those other things happened that I posted above then it is on the Business.

You know who is good for not repairing and replacing equipment in this Country? And FYI I know this for a fact considering the amount of family & friends that worked there...Exxon. They are a company that runs everything till it breaks and falls apart. Mobil Oil was a company that did Preventative Maintenance, fix it as soon as it even looks like it is going to break or they would rebuild/replace said parts within a certain timeline. When Exxon took over Mobil Oil back in 1999 or 2000 everything changed at my dad's plant. They went from being the 1st Star Refinery, The Longest Star Refinery (And if you look up what a Star Refinery is, it takes a lot to get) to being listed as a Standard Refinery all because of Exxon's Business Practices. They are also not the best at providing training vs what Mobil Oil used to.

The Meat Packing people were pissed because they had been in close contact with these people for several days. All of a sudden they disappeared and when they would ask are they sick the company said "no comment". That made them think hmmmm. Then out of nowhere people started coming down with symptoms. So yeah that company made a decision that bit them in the ***. If they had disclosed people had come down with and in private asked if you were in contact with this person. We advise you go and get tested right now. They didn't do that.

The problem is when the employees ignore what they are taught, the employer has to pay significant fines. One simple fine from OSHA used to be $27,000, called a willful violation. Many employees are not familiar with all of the dangerous chemicals that they are working with, so, it is the employer's job to make sure that their employees are properly trained and protected. It's not always a simple common sense issue. I had to supply MSDS (material safety data sheets) for every job that I did. And, it was my responsibility as an employer, to make sure that my guys were following all of the safety protocols. That was my experience as an employer who had to deal with OSHA. It's a biitch when OSHA shows up and cuts the ends off of 50 power cords because the ground plug is missing, but it happens all the time.

Yeah, it is a common sense issue. If your employees didn't already know what the safety protocols were then they shouldn't have been working for you to begin with. They obviously lied to get the job.

It's not just a ladder or height issue, it goes deeper than that. It's how to handle dangerous chemicals and odors. It's not as easy as you guys wish to believe. There is a lot of employer/employee training involved.

It's not that easy. I told my employees to take July 4th off. Well, they showed up anyway. So, I got sued for a million dollars because I didn’t have supervision on the job and one of them died. So, this is real life, not opinions.

So, downplay it all you want, I lived it. The employer will always get sued and blamed. We paid the fine for not having supervision on the jobsite on a holiday. Common sense, right?
 
My company was fined 10,000$ back in 2014 because one of my guys decided to stand on top of a 6 foot ladder while working outside. An osha supervisor just happened to be sitting at the stop light in traffic. The stupid people aren’t the ones who have to pay for their own mistakes.

Sounds like you WANT to accept blame for that incident as much as you are fighting for it. Covering something up?

If you told your crew that nobody was to work on the 4th of July and he showed up stoned and drunk and got himself killed and you accepted liability then YOU are the idiot. He was trespassing and under the influence. You should have sued the survivor. Unless you were one of those bosses that said nobody is to come in on the 4th of July but if this job isn't done by the 5th you are all fired and I will get some more employees from the Home Depot to replace you, then it wasn't your fault and you should have got a better lawyer. <------ common sense.

Now if you employed illegal workers perhaps you were weighing the $5,000+ fine per worker and up to 3 years in prison per each illegal worker hired. Not to mention all the fines for paperwork. I would imagine a construction crew could consist of many crew members. Hell, if you had 10 illegal immigrant workers that could be a $50,000 and up to 30 years in prison. Hmmm $1,000,000 payout or 30 years in prison..........
 
A lot of this stuff comes down to workers compensation insurance more than osha fines. Those insurance companies will stick it in sideways and twist it if you have a lot of claims, and they will go back and audit the entire past year, change your policy, and charge retroactively. They’ve been given a license to steal honestly.

We had 240 employees and we did win the lawsuit, but we still had to pay the $5,000 fine for not having supervision on the jobsite because it wasn't in writing. Btw, it's not up to the company to know if the employees are illegal or not. If they give me a driver's license and social security card, then, I can hire them. Employers don’t have access to a list of all of the fraudulent Social Security cards and Driver's licenses out there. Actually, the labor board did a complete audit of our employees and some were using the same social security number. So, we had to let them go. And, there was no fine to be paid or jail time. So, no, we weren't hiding anything. We took good care of our employees. Every Friday we paid our guys at the bar and always had a buffet of food for everybody.
