or if that dont work go to the cops and show them that the truck is behind on payments and that it is in your name and they will go over there and make her give you the keys

She had insurrance on it when we baught it, but the last i heard, she stopped it cause she couldent pay it or something like that. and i agree bout the rest, but the last part is wrong, the only reason why we did a joint account was cause she couldent get it on her own, i could of got it on my own, but we wanted to get her credit going because she had none. thats y we did a joint.
i take it as a lesson learned and im gonna look into a lawyer and see what i can do.
Hmm.. Ok, so you are the co-signer then right? This could work in your favour when she completely defaults and the bank ends up telling you that you will have to assume the payments. You can get the bank to repo it to you since you will be taking things over.

this is just another reason why i told him he has to get that thing insured. he can also speak with the place where he has his loan, tell them the situation and it's possible they can get him the truck back since she is no longer paying on it.

If both parties are responsible for the loan and signed to guarantee it, one party usually can't get off the loan unless the other requalifies and assumes the remaining principal amount. If the loan is already in trouble why would the bank want to lose one of their options for recovery?

I am not saying that going to an attorney is a bad idea, I just find it odd that someone can quote the range of the fee as if he can just pay that amount and his worries will be over.

The fact is that the you can't just be "removed from the loan." The bank agreed to the loan only on the condition that he put his credit on the line. There is no simple way out of this, especially if she is not willing to work with him.

They know every attorneys fee structure uh duurrrr.

NO WAI!? Are you saying he agreed to make sure that note was paid one way or another by signing that agreement? Thats crazy talk right there.


Bottom line is that the banks don't give a crap who has possession of what. All they care is that the individuals who signed pay the loan. Everything else is your problem. Maybe there is something you can or can't do legally but it isn't all that simple. Until you get something done legally about it, you both are responsible for that note. Don't expect to have it taken care of "just like that" either. So if you don't want your credit to go down, pay the note for her and then hound her for payment. The rub in doing that though is that it shows you make solid proof that you accept that credit liability.
