My tweeter keeps cutting out

As most of you probably already know I have a Hertz component set for my car. The Hertz Energy ESK 165 S to be exact. They have the EV 165 S speaker and the HT18 tweeter. Now my question is, everytime I get the volume to 20/35 the tweeter on the driver side quits. At 19/35 it cuts in and out but at 20/35 it just stops working. I was listening to some band called Ministry. I checked all the wiring and that, and everything is fine. I really haven't played with my amp setting yet. But I have the Bass at 0, the Freq at 90 and the sens probably about 2.5. I have the Phoenix Gold 4.0:2 2 channel amp on this set. Both sides are getting 75 watts RMS each. I even tried different songs and the tweeter still cuts out at 20/35. Is my tweeter already screwed up?

 
sometimes in a coaxial a tweet will do that. the crystal melts when it gets too hot to protect the tweeter, once it cools off the crystal hardens and you have sound again.
