i bought my car in dec.

when i applied for the title it got sent back.

the dealer i bought it from cannot get the title, thus he broke the law and sold me a car he did not have a title for.

i know i can get my money back but can i sue for any type of punative damages?

because technically what he did was fraud.

What paper work did he give you? What did you give to the DMV for the title application? Does the car return in someone elses name, stolen or just "no title"? Who does own the car? Did it have a license/registration when you bought it?

I'm just trying to figure out if this is a car that has no title (lost, junked, etc), or does someone else hold the title?

You can buy/sell a car with no title. You just can't register them or drive them on public roads. This is fine if it just stays on the farm, race track, museum, etc.

You can't buy/sell a car that someone else holds the title for. These are two different things.

Read your paper work.
