Legal advise needed

I am looking for some advice for a friend of mine. He just purchased a used 95 Legend GS on Friday. The seller came and dropped the car off at his work. Well today was the first day he did a good amount of driving with it. It was fine in the morning, but after sitting and being restarted it began to smoke. It smells like burning oil, not sweet like antifreeze. Apparently these cars have a history of valve seals going bad. He paid 2,600 for the car, but so far has only paid the seller 700. He is supposed to pay the rest on Monday. They both signed a piece of scrap paper saying that he agreed to pay the remaining amount on Monday, and my friend has possession of the paper. My friend called the guy and told him what happened and said he wants some money off the car for the repair since the guy said nothing was wrong with it. The guy said he did notice a little smoke before he dropped it off, but didn't think anything of it. The guy only wants to give my friend 300 bucks off for basically having to replace all the valve seals in the heads. Anyway, is there really anything my friend can do in this situation?

 
actually in court they would ask for the pieace of paper promising to make payment, called a promissory note..all he has to do is say they agreed on $700 to take the car for the weekend and if he still wanted it by monday he pay the rest, if not then get your 700 back and give him the car back..

So basically if he doesn't want the car he should either A) wipe his *** with the note and flush it down the toilet. or B) tell the guy he will rip the contract up if he doesnt either give him his 700 back or pay for the repair.

 
Oh and I just found out my friend has a bill of sale they both signed as well but the guy only wrote 1800 on it as the selling price.

your friend holds all the cards if he has the only copy,if your friend really likes the car let him name his price..if the guy doesnt agree and have him tell the guy well look, heres whats gona happen, i have the only copy of our agreement, eiter you give me my $700 back and you get your car back, or i keep your car and you keep my $700..the other guy cant do anything about it, but does your friend have the title of the car?

Yup he has the title and everything.

 
well since he still has the note, he still holds the cards..tell him to get his 700 back..if he refuses he can call the cops and tell them the story of having the car over the weekend and a trial basis..the guy will admit to having your friends cash because hes going to want to sell the car..and if he denys this your friend has the note to show the cops, the guy knowing this will not deny the sell of the car..

Yeah right now he's just going to try and get his money back from the dude

 
something to think about, have your friend ignore the guy all day monday or whenever hes due to give the money, then the next day have your friend answer his call or your friend call him, and he will ask your friend what happened yesterday, your friend can say he had to take his brother or mom to the hospital they are injured and he needs his 700 for the bills..maybe the seller has a heart and wont have a problem giving the money back..
