you need a good 15 -20 miles per hour for the frame to even get touched.

OP I believe insurance has a set % of damage your car must have in order for it to be totaled. I believe it is about 80% but not 100% sure on that but it is up there.

I have this odd idea and I realized it may be totally crazy but have you tried calling your insurance company any asking them??? Also did you do the damage or did someone else?
