IDMAX situation, help if you can

I bid on some IDMAX subs on an auction for ebay almost 3 months ago. I paid right away through paypal and the total came to $660 dollars. There was a backorder for IDMAXs for the longest time, so I didn't think anything of not getting these subs. The subs are on backorder again now, but were not on back order just a few weeks ago. The guy I am dealing with, Jesse Matlock, has said that he wouldn't give me a refund because he already paid for the subs, he's said this many times, however when I talked to Image Dynamics corporate, they said that Jesse Matlock has not made a commitment (not paid) for the subwoofers at all, and that he failed to get his order in for the IDMAXs before they went on back order again. Now, I keep trying to call him and send him emails, and I have no response at all to either of these. Needless to say I am a little more than pissed off about the situation. He should give me a refund right? Anyway, I've tried paypal to get a refund, but they only give refunds before 30 or 60 days, and I missed that time window. I didn't pay through credit card, but my bank account funds so there isn't much I can do about that either. Is there anything I can do? If he's going to steal from me, I'd like him to get into trouble for fraud or theft or something like that. I can call Image Dynamics again to get Jesse's contact information (he seemed to have moved very recently), or try to, but the woman (who is very nice) doesn't seem to be in the office all that much.

is there anything I can do? I'm mad enough now to forget about the money and just put the screws into him if I can. What sort of business man won't give a refund if the customer asks for one when that customer has seen nothing at all in return?

The whole situation could iron itself out over time. As long as you end up with the subs when they come off of backorder all will be fine. I would not "put the screws into him" until you decide that he is going to take advantage of you, and try and keep your money without sending you any product. As far as it looks from here, without all the details that you might possess, it looks like he just doesn't want to lose a sale that he has already made. Even if it costs him a future sale. That's my take anyway.

 
ebay help seller not selling fraud... fill it out send it in guarantee he replies put the screws to him ...he cant be straight u deserve your money back either way u get ur woofers or ur money back as i see u wont do business with this guy again anyhow

 
I just think that as soon as you start messing with this guy he's going to do whatever he can to make sure you don't get your money or product. Just think about that for a sec.

If you do want to push the refund issue that's on you, I would be all for that because he shouldn't be selling something he doesn't actually have. eBay is for buying things at auction, not for placing an order for something. If he didn't specifically say something about him not actually having the product I would stick it to him for a refund, because he misrepresented what the situation actually was. You have definitely given enough grace period for him to come up with the product he sold you.

that is theft, and in this country, theft is illegal. How come someone would do that? I have sent him an email saying that I'm unhappy and that he should give me a refund. He's not making a terrible amount of money off me, maybe a few hundred dollars... I don't see what his problem is. And, I waited long enough, it's been THREE MONTHS. I don't care what it is that I'm getting, I don't want to wait any longer to get my product. Iron things out in time???? how long will that be? 6 months? 8 months? a year???? heh, I have no idea how anyone can sympathize for jesse matlock here. An honorable person would simply refund my money.

 
Noone can sympathize with him. He sold something he didn't have at an auction, that's not right. Even the best case scenerio I came up with still had him being an a$shole. Go get him then, you've been plenty patient up to this point. Noone can fault you after being without your $660 for 3 MONTHS!!

if you file the ebay fraud case (he did a transaction via ebay) you have proof he has your money some how i hope....then file the fraud cse if he is guilty poof he gone from ebay and then u can press issue...as a seller on ebay it clearly states u must have the product to sell ..he clearly doesnt. not only is it fraud it is premetitaded sale with knowing you would have a wait without telling you so he has your money......put the screws to this jerk and tell eric stevens his good stuff is being put on ebay by a dishonest man...i dont think he likes it there in ebay anyhow,
