Sure, she was contributory. So was he. I think alot more factors will be used to determine the actual amount of contribution to the accident than the drunken ramblings of a man who was just involved in a car vs. pedestrian accident. Also, if he wasn't yet under arrest or properly Mirandized, then his statements may very well not be admissible.
Face it... the girl ****ed up. Maybe her stupid-*** boyfriend shouldn't have parked somewhere that would put her in danger when she came to talk to him. Maybe he should have been a gentleman and gotten out of the car to come talk to her. Maybe her mom should be at fault for upsetting her and hurting her feelings. Maybe her mom should be at fault for allowing her to drink (if that was, in fact, the case). Maybe Mr. Jim Beam should be liable for producing an intoxicating beverage and not working hard enough to prevent a minor from drinking it, or the driver from driving afterwards. Maybe the gov't should be responsible for not having speedbumps in place in every residential section in America. Maybe the auto manufacturer should be at fault for not having a required breath test for every car, or for not having proper Star Trek-style scanners in place to prevent any possible collision, or a governor on the engine at 20 MPH.
For God's sake, anything other than assigning a single ounce of the blame to the poor, drunk-as-shit streetwalking teenie-bopper.
