That's absolutely silly. What legal jurisdiction do they have claiming private property as public?
It's like the radar detector laws - technically those should be nullified, but the only reason they're on the books is because it would cost too much to fight a case to change the precendent.

Don't remember the exact case right off hand. I'll look for it. I went to court earlier this year for this. Emminent domain only applies if the state has a pressing interest to use your property, like for a gas line or construction project? Yeah, I really can't see where eminent domain has any bearing on the states ability to change your land use from "private" to "public" simply so they can bust you with open container on public property and public intox.

On a different note along the same lines to prove the local cops are a PITA . THis instance was even more pathetic

Instead we decided to walk to the Macadoos right next door to his apartment. His apartment is overtop a building that is literally next door to the bar 30 seconds walking tops. We went over had a few drinks. Decided to walk home once again right next door . You have to walk around a fence in the parking lot of the bar to get to his apartment . As we rounded the fence saw the lights flashing and heard the siren. The two fine officers arrested my friend and I for being drunk in public. We were doing nothing but walking home. Luckily I have moved since then.
