Got into accident, will my insurance write me a check? insurance fraud?

Ok so actually some guy hit me out of nowhere it was his fault and he was mentally retarted (seriously), now i dont want my car to get fixed, so will his insurance write me a check or will they only write it to a repair shop? Is there any way for me to just get the money?????//

They will write you a check. You can spend it on the repair or spend the cash on dope. The insurance company could care less.

Do you owe money on the car? If so they usually write a check for both you and the shop to fix it. If you own the car out right then they pay you.

See above...things may be different if you have a note on the car. That has never applied to me (getting into an accident while making payments). I am sure the person holding the note has "first dibs".

No i am not making payments and the car is still drivable (just a badly dented fender)

if they send you a check. look into getting the repairs done on the car. for one you say your fender was hit. if your fender was bent up he might have hit your wheel. in which you should get an alignment check on it. look into getting stock replacement parts off the net to replace the fender, then get it painted on the car. you can replace the fender yourself as they are quite easy to take off and put on. after you get the repairs done you can spend the rest of the money on the audio.

If the insured vehicle has a lien holder and the damage exceeds $500 it is mandatory that the lien holder be included on any settlement drafts in all 50 states. In the event that the insured is having the vehicle repaired, the above can be forgone by making payment payable directly to the insureds repair facility of choice (with valid tin).

considering you have no lien holder, they will write it up, and issue the draft made payable to you only for the amount that exceeds your deductible...

should you have to file a claim in the future and if the new damage overlaps the same area from this claim, without documentation of repair they will deduct the previous settlement from the new settlement until sufficient proof of repair is provided...

if its just a fender bender why not get the car fixed rather than report it to the insurace

what is you deductable? if its about the same as to get the damage fixed....ya

also if its just a minor fender bender,the kind you really cant see, why not just let it slide?

Some lady hit my bumber (chevy truck) and it was very minor ,the dent was about the size of a pencil eraser.

I just said screw it and we both left
