Do Not Buy From Woofersetc.com!

I wanna hear what they say when you call them on it. I bought an 880PRS from them last year. They price matched another online site and it's been flawless. I'm curious how this plays out, though.

At the CES show in Vegas a few weeks back Focal released a statement to all dealers and make them sign dealer agreements that if anyone sells online
That they can do...
or below msrp they will be cut off from the line.
That is illegal. They can disallow them from advertising below MSRP but they cannot control the actual sale price. Doing so violates price fixing laws.

Not true. Its the same reason that every store sells PS2's for the exact same price. Or if you go to Macy's and see Ralph Lauren or Tommy Hilfiger non-liquidated merchandise never on sale. The companies can make their distributors sell at a specific price.

It's a fine line, very fine. If the retailer "agrees" to do business with the manufacturer and the price is part of the agreement, it's price fixing of the illegal variety. The whole thing is working a loophole in the Sherman Anti-trust act, but the loophole is a tiny one. One slight misstep on the part of the manufacturer and they are liable for treble damages...

A manufacturer does have a legal right to set a suggested retail price (a manufacturer's suggested retail price or MSRP). The manufacturer also has the right to unilaterally terminate a retailer who prices below the MSRP. Frequently, when prices are identical for a product at every store, it is because each retailer has decided to adhere to the MSRP.

^^^And if you read the article and do some further research, if there is any discussion between the retailer and the distributor/manufacturer concerning price, the law has been broken. Even a threat of yanking the account based on pricing constitutes a violation. Any action taken by a manufacturer MUST be completely unilateral. If any other party is involved, the law is broken.

I just got off the phone with Woofersetc. They have been very good about the whole ordeal. They stated that the last digits of the serial number were removed so that they could protect their distributor from being cut off by Focal for selling below MSRP. They will be sending UPS to pick up the speakers in the next couple of days. Despite my worries, the customer service has been great. They offered to let me compare the speakers to a set without an altered serial number or to replace them with some other speaker, Focal or otherwise. Due to the scare, I think I will be going with another brand. Despite all this, I am happy with the service I recieved. Becase of this, I will continue to do business with them.
