yeah except the contract between the 2 for the rest of the money has been broken so the deposit is void. go try to buy something on layaway and leave a deposit then dont pay when your suppsoed to. do you get your deposit back? no. do you get the stuff whenever you finally decide to pay? no. it is his own fault and he has no claim to the money.
