In FL, you don't have to merge if you feel you can't, but you are then required to seriously slow down and that is where is becomes officers discretion on if you slow down enough.
Law in TN is to move over....but I am not going to slam into a car parallel to me so I can move over per the law. I do slow down as much as I can...if the speed is 70, I slow down to 40-50....If the limit is 50, then I slow down to 30ish. I want the policeman to know I tried.

 
I hate this dam law.
it should be like the left lane/fast traffic law

I dont think it should be heavily enforced, and the only ones that usually do are dick munchers

its a courtesy thing, and it is a danger to police/emts (my wife is an emt), but if theres no where to go, or if no danger is posed, then there is absolutely no reason for the cop to be **** a little ***** about it (I work with officers, and am friends with many of them), hes a disgrace to public service, and is doing nothing but further enforcing the stigmas against officers

they really need to do an ******* evaluation before hiring

 
I think that being an ******* comes from low pay + people kissing your *** all day.
While I hate the law, I have personally been merging over when possible for as long as I have been driving.

While my friend's brother isn't a police, he works for a trucking repair deal where they do road calls.

He says that is some dangerous shit...being on the side of the road, on the interstate, at night with nothing but some flashers on. He said that cars tend to drift toward the side of the road.

exactly, they are attract5ed by the lights, and rubbernecking, not even paying attention to wtf they are doing

 
Did you not read my last posts? I saw him there, I didn't hit him or even come close to him. I'm not going to cause an accident by slamming on my brakes or cutting someone off. So it's a law I broke without knowing it. I don't know about you, but I stay off my cell phone, and since my truck has a shitty system, its never on. I was fully aware and not preoccupied, or drunk or high. I find it hard to believe under those circumstances that I should be nailed with a big *** fine. Especially with my perfect record.
Thing is it is a law that you didn't know about, but you should have. I see you are from Ohio, same as me. Matter of fact not but half hour from me if you are in Akron. He probably was pissed cause of traffic. You say you were not close, but to him it is obvious that it was. So yeah it sucks and he shouldn't have treated you that way, but if it was a statie, well 9/10 times those guys are dicks, especially in Ohio. Our highway patrol guys are motherfawkers mang, trust me. I know from expierence that you almost always will get a ticket and treated like a complete imbecile with those guys. Most locals or the sherriffs department will give you a warning......in some cases, it just depends what the situation is.

If it was a statie, then you may be screwed, cause they show up most times in court. I mean you can try and explain your story to the judge, but good luck! And going and talking to his chief would be ok if it was a local cop, but Staties are another thing and have a feeling this is who you got pulled over by.

Also the reason I quoted this particular post was due to the fact. Everyone at one time or another has had a clean record, lol! I know I did when I first started out driving eons ago. I had 10pts on my DL as you should know in the state of Ohio 12pts and you lose it for up to a year, most cases 6 months. Well now that I know this law exists, I'll admit I was wrong right now. I even asked my friend right after he left the scene and he said "I didn't know that either". I wonder how many people my age know that law?

As a licensed driver, and by signing your drivers license, it is YOUR job to know the laws, and keep up to date with them. So an ignorance plea WILL NOT fly. I dont know the exact law in OH, but in MI, we are either required to:

A: Change lanes and give ANY emergency vehicle a 1 lane buffer (police, fire, tow trucks, courtesy vans, etc)

B: If it is not possible to change lanes, SLOW DOWN and pass carefully, giving as much room as possible to the stopped vehicle. This is pretty much acceptable ONLY in heavy traffic situations.

If you are going to file a complaint about the officer, you may as well paint a big red X on your vehicle! Pick and choose your battles out there!!! If you go to court, take a witness (your friend) and offer him to the judge (or prosecuter) and have him speak AFTER you plead your case, and preferrably not in the room while you plead it. Also remember, most traffic stops are recorded.....

Well I'm going to be speaking with an attorney today. For those of you in Ohio, it was a Summit County Sheriff. The cop shouldn't be standing next to a lane on an interstate, period. But I was a safe distance from him doing about 50. So really, I don't see the harm in what I did other than breaking a law unknowingly and if that means I get fined, oh well.

Also, to what's in bold. Every vehicle I drive has a big red "X" on it for reasons I don't wish to discuss. Like I said before, I think he saw this as an opportunity to pull me over but I'm not 100% sure at this time.

 
Plead guilty and ask the court for leniancy. They will give you a reduced fine and 30 days supervision; it won't go on your record.

If you plead not guilty, chances are extremely high that you will walk with a conviction on your record..... even if the officer is not present.
