Law in TN is to move over....but I am not going to slam into a car parallel to me so I can move over per the law. I do slow down as much as I can...if the speed is 70, I slow down to 40-50....If the limit is 50, then I slow down to 30ish. I want the policeman to know I tried.In FL, you don't have to merge if you feel you can't, but you are then required to seriously slow down and that is where is becomes officers discretion on if you slow down enough.

He says that is some dangerous shit...being on the side of the road, on the interstate, at night with nothing but some flashers on. He said that cars tend to drift toward the side of the road.
Thing is it is a law that you didn't know about, but you should have. I see you are from Ohio, same as me. Matter of fact not but half hour from me if you are in Akron. He probably was pissed cause of traffic. You say you were not close, but to him it is obvious that it was. So yeah it sucks and he shouldn't have treated you that way, but if it was a statie, well 9/10 times those guys are dicks, especially in Ohio. Our highway patrol guys are motherfawkers mang, trust me. I know from expierence that you almost always will get a ticket and treated like a complete imbecile with those guys. Most locals or the sherriffs department will give you a warning......in some cases, it just depends what the situation is.Did you not read my last posts? I saw him there, I didn't hit him or even come close to him. I'm not going to cause an accident by slamming on my brakes or cutting someone off. So it's a law I broke without knowing it. I don't know about you, but I stay off my cell phone, and since my truck has a shitty system, its never on. I was fully aware and not preoccupied, or drunk or high. I find it hard to believe under those circumstances that I should be nailed with a big *** fine. Especially with my perfect record.

Well now that I know this law exists, I'll admit I was wrong right now. I even asked my friend right after he left the scene and he said "I didn't know that either". I wonder how many people my age know that law?
Well I'm going to be speaking with an attorney today. For those of you in Ohio, it was a Summit County Sheriff. The cop shouldn't be standing next to a lane on an interstate, period. But I was a safe distance from him doing about 50. So really, I don't see the harm in what I did other than breaking a law unknowingly and if that means I get fined, oh well.As a licensed driver, and by signing your drivers license, it is YOUR job to know the laws, and keep up to date with them. So an ignorance plea WILL NOT fly. I dont know the exact law in OH, but in MI, we are either required to:A: Change lanes and give ANY emergency vehicle a 1 lane buffer (police, fire, tow trucks, courtesy vans, etc)
B: If it is not possible to change lanes, SLOW DOWN and pass carefully, giving as much room as possible to the stopped vehicle. This is pretty much acceptable ONLY in heavy traffic situations.
If you are going to file a complaint about the officer, you may as well paint a big red X on your vehicle! Pick and choose your battles out there!!! If you go to court, take a witness (your friend) and offer him to the judge (or prosecuter) and have him speak AFTER you plead your case, and preferrably not in the room while you plead it. Also remember, most traffic stops are recorded.....
