COURT! Anyone been for serious charges? Got first date comin up, no lawyer

Im coming into this late, but not going to read 10 pages.

If you havent gotten an attorney, go to your arraignment and tell the judge you need a lawyer. They will get you one. If you have no prior convictions or arrests, you will likely plead guilty to a lessor charge(not at the arraignment). They could drop the possession of a concealed weapon charge and get you on a misdemeanor possession charge that will likely result in a suspended sentence or probation.

By the way, the arraignment is where they read the charges against you and ask if you will need an attorney. The arraignment takes place within 72 hours of arrest if I remember correctly. Each state has their own rules for arraignments.

Lastly, get your crap together. Losing your freedom is worth smoking some blunt?????

My arraignment is tomorrow actually, I was arrested over a month ago though so its alot longer than 3 days

So tomorrow basically there just gonna read me all my 3 charges and I plead guilty or not guilty right....

heres a quick question, my concealed weapon charge is set BY ITSELF at a different time in a different courtroom tomorrow. Does that mean it will get a seperate courtdate aswell? Since the BB gun "should get dropped" you guys say, can I say I want a public defender for that? Or will it be lumped into the drug charges?

The drug charges are in the morning together, even though I have every INTENTION now (unless offerred a good deal that keeps me out of jail) should I say YES to a public defender? possibly see what they can offer me (will he tell me within a couple days or even that day what he /she can do for me?) And then I can go ahead and hire a lawyer if I dont like it or feel they wont try for me?

Id really just like to stay out of jail, dont care if I go into any programs

I would just go straight for hiring an attorney. The sooner you contact one and inform him/her of what happened the sooner you will have an idea as to the outcome of the situation.

I may make a little sense because I actually have a B.A. in Criminal Justice and spent 1 year in law school.

DO NOT PLEAD GUILTY TO ANYTHING. Were you actually booked into the county jail? This means they cuffed you, put you in the back of the car and took you to jail where you were printed and had a mug shot taken?? It sounds to me that they gave you a summons to appear. Basically like a traffic ticket and you have a date to appear.

What state are you in?? i am amazed that you have 2 different court dates, one for the possession and another for the concealed weapon.

In any event, when you go to court, they will not ask you to plead guilty or innocent without having an attorney. Make sure you tell the judge you want an attorney. That is it, answer nothing other than you understand the charges against you and you want an attorney. This not like a high pressure salesman. They arent going to offer you some great deal and tell you that deal will be off the table if you dont immediately accept it. the wheels of justice are slow moving. GET AN ATTORNEY. I personally would want a public defender in your case. It isnt a major case and you wont spend big bucks, but that choice is yours.

I do not want to lesson the seriousness of what is happening to you, but in the large scheme of the court system, your case is a minor one. One in which the D.A, and public defenders office will want to work a deal really quick and be done with it. if you have no priors this will not result in you doing any time in ll likelihood.

Hopefully it all works out well for you and you learn a lesson. There is NOTHING worth losing your freedom over.

Yes I was arrested, put in cuffs, thrown in the patty wagon, brought to jail, stripped, printed, pictures, documented my new tatoos, thrown in a cell for a couple hours til they released me.

I am in canada btw so no state, but yes I have to different TIMES for my different charges, but the same day.

A public defender is still considerred an attorney you mean you think i would be ok hiring one of those?

So basically tomorrow they are just going to ask me if I hired a lawyer or if I need one apponted? In which case I should say yes..... take the free help and see what he can do for me, if Im not happy, hire and pay the bucks for a real one?

I have absolutely no clue how things work in Canada, so EVERYTHING I said was in regards to laws in the United States.

If they offer a public defender in Canada, take it. They are not idiots and your case is just not complicated enough to warrant hiring your own Lawyer in my opinion.

meh.

i know in my case im happy i got a lawyer rather than a PD. they were going to give me a year probation and my charges stay (2 felony sales and 1 felony possesion of pot). i got the 2 sales down to possesion and in drug court which is cheaper and i wont have any problem getting my case sealed when im done with it.

You are probably going to be indicted on the drug charges, therefore you will be infront of a grand jury instead of a municipality judge for the pellet gun. The MDMA (X) you are being charged with is a Schedule III offense in Canada, pretty serious shit.
