Is your only complaint that he made a copy for himself? What does it matter to you? Are you interested in the CDs or no?

Complaint? Let me restate that I am NOT complaining. I don't care if he is or is not doing anything illegal. I was merely using that eBay listing as an example.

So, since you guys are all sharing a single brain cell and have nothing to add besides the equivalent of "*****", go find another playground.

For those that like to discuss things in an intelligent fashion, let's disregard that eBay listing. How about my collection. Is it okay for me to rip a CD (say using FLAC) and then turn around and sell the physical CD to someone else while retaining the digital copy. I'm fairly certain there is some type of "single copy" rule wrt copyrights.

Anyone here have any legal background?

Dont ask/dont tell. If you make a copy of it keep your mouth shut. When you list an auction, dont be like the moron above a state that you made copies. If you take them to your local "Five and Dime" to sell them, again, keep your mouth shut.

Again, I ask you, what is your point????????????

Your patience is wearing thin? Your ability to grasp the simple concept presented is wearing thin. This isn't about social norms or your "don't ask don't tell" policy.

This is about the law. I am wanting to discuss the law. The eBay listing was used as an example. Do you know anything about copyright laws? Any info you have would be appreciated.

I found a tidbit wrt computer software, which may be similar to how digital copies of music are handled...

"Copyright and Digital Files

Can I backup my computer software?

Yes, under certain conditions as provided by section 117 of the Copyright Act. Although the precise term used under section 117 is “archival” copy, not “backup” copy, these terms today are used interchangeably. This privilege extends only to computer programs and not to other types of works.

Under section 117, you or someone you authorize may make a copy of an original computer program if:

* the new copy is being made for archival (i.e., backup) purposes only;

* you are the legal owner of the copy; and

* any copy made for archival purposes is either destroyed, or transferred with the original copy, once the original copy is sold, given away, or otherwise transferred."

If the above applies to digital copies of CDs, then I am correct in my assumption. It seems you can have a backup, but only if you retain the original as well.

Again, please realize I'm not for or against music copying/distribution in this discussion... I want unbiased discussion.

Hmmm... so, how are "backups" of music handled. Everything I find says you cannot create copies, even for personal use.

 
A little better explanation...

"The First Sale Doctrine of the 1976 U.S. Copyright Act allows someone who purchases a recording to then sell or otherwise dispose of that recording. But a person who sells or gives away a recording may not keep, sell or give away any other copies. In other words, if only one

copy of a recording was purchased, then only one person should possess it and any copies made from it."

Also, it seems that it is a tossup whether or not even ripping a CD for your own personal use is "legal". I find that pretty silly. So, I'm supposed to buy the CD to play in my car and buy the mp3s to listen on my computer? No way.

 
Looks to technically be illegal. He can make copies but must retain the original. But lets be honest, me, you, or joe schmoe can sell our CDs as long as you keep your mouth shut about your computer. It is therefore clear, according to Kohn, that Congress believed that the Doctrine of Fair Use, which is now embodied in Section 107 of the Copyright Act, protects audio home recording from copyright liability as long as the MP3 file is for your own, noncommercial use and you do not distribute copies of it to anyone else.
The ruling, in June 1999, by the U.S. Court of Appeals in the RIAA vs. Diamond Multimedia lawsuit over the Rio portable MP3 player makes it even clearer that Doctrine of Fair Use allows consumers to “space-shift” and “format-shift” music by ripping it to their hard disk and converting it to MP3.

So Robert’s MP3 files are perfectly legal, (although for a different reason than he was told by his lawyers), as long as he purchased (and still possesses) the original CDs. However, he may not sell or give copies away, or use the copies for any commercial purposes.

r u such a ***** that ur scared to just sell ur cds after u ripped em , just dont tell any one back em up and sell the originals its a no brainer

 
I'm all for the don't ask don't tell policy. With a collection like the one in that eBay listing, I would be hard pressed to part with it. What if your hard drive fails... what if your backups get corrupted. Now you have 1200+ albums down the drain. That's the only thing keeping me from selling my collection.

I'm just going to stick them in a few big boxes and store them away. That way, when my son gets old enough, he can go through them all and thoroughly make fun of me.

So, it seems that multiple copies are allowed for personal use and/or archiving. But, said copies must be destroyed if the originals are ever sold or given away. I figured as much. Never really thought about it.

But, of course, this goes against rules for computer software... supposedly, unless specifically stated, you are to have software on a single PC, even if you own multiple PCs.

I'm very surprised the Microsoft allows 3 copies of their Home/Student version of Office.
