I was browsing good ol' eBay and came across a CD collection auction for 1200+ CDs.

In the description, he states:

"People have been asking why I am getting rid of my collection:

I have uploaded all my albums on to my computer and back up hardrive."

Maybe I'm mistaken, but making a copy for yourself and selling the CD is the same as ripping a CD that someone else has purchased.

Is this NOT copyright infringement?

I sent him a message asking him about this, and he replied with:

"Copyright Infrigement occurs from illigally downloaded music. Not legally purchased and uploaded music. Let me break it down for you.

I have transferred a legally bought medium, and converted to a different type of medium for my own use. CD to MP3. I own the albums because I bought them. They are now my to sell as I please, as I am not duplicating and reselling burned versions of said complete collection. Even then, those copies would have been mine from a legal purchase.

Downloading shared music is Copyright Infrigment because you make no purchase what so ever.

Here's a better example. You take your VHS movies and convert them to DVD. why would'nt you be able to sell your VHS copies which you no longer need? You can, of course - they're yours!

Anyways, if your worried about bidding, don't.

I'm not worried... just trying to clear up my thoughts on the subject. I've ripped my complete collection to my computer as well, so this may apply to me if I decide to sell.

Interesting argument... not sure what the law says @ this point. I have all of my purchased CDs backed up on my hard drive, but still have the originals too.

For example, if this trend continues, the next guy pays for the CD and rips it, then sells, so on and so forth... so, the artist/label only gets the $$ from the original purchases while multiple copies are now had.

 
I don't even bother to DL music... my time is too valuable to waste searching for decent bit rates and so forth. I signed up w/ BMG Music and usually pay about 5 - 7 dollars shipped for my CDs when I buy them averaged out over the whole order. They owe me about 10 free CDs right now (technically 2.99 each due to shipping, still cheap).

If BMG doesn't have it I usually go to Target -- they are reasonable there too with many new releases going for 10 - 12 dollars.

But yah... I'd like to know what the law says about this too for my own information.

I only DL stuff I can't find on albums (live, rare, etc.). I have been a member of BMG since '99. I LOVE that place. You are right, the average cost per CD is 5-7 shipped. They have great deals on boxed sets, too. I bet 1/2 my collection has come from them.
