Car totaled

If there is a private suit... how does that work for the person he sues? They will have to pay this out of pocket? I thought that was the main reason for insurance... to protect yourself from having this happen. I hope I never hit someone where it is my fault.. I would not be able to deal with a private suit.

 
The insurance company will always try to shortchange you ... Have everything that happened documented as well as possible (medical bills, lost wages, damage/worth of vehicle, etc.) and sue for an appropriate amount. If you bought the vehicle recently and blue book value has dropped significantly, you can usually get more than blue book value by suing.
My friend lent his car to his friend, who crashed it. Insurance company was going to give him blue book value, which was $8,000 at the time. A little over a year earlier, he paid $17,000 for it and still had about $12,000 in payments left at the time of the accident. Because he sued, he ended up getting enough to pay the rest of his car payments and then he took out another loan to buy another vehicle.

That's the impression I was under. But I could be wrong.

 
The insuracnce company will always try to find loop holes to make a defendant of a suit pay out of pocket. They have all of the tricks memeorized, to get the insurance company to pay a suit for you, you have to have really good coverage on just about everything.
What does "really good coverage" entail?

 
im not sure what all you have to have on your policy, but i worked ina court house as a assistant to the clerk of court, and i always saw car accident suits where the insurance company got out of paying, but i know it happens more often that not that they dont pay. Remember they are in the business to make money

This guy totaled my car and injured both of us, I dont care what i have to do to get my car payed for, **** insurance companies, i know i will get barley shit anyway. Im not gonna lie to anyone, im just so pissed at this ******* i just want my shit paid for
I am with you. Certainly being checked out at the hospital(although I would strongly recommend seeing a chiropractor....you two could have had your backs/necks jarred pretty good) is just being practical. It has NOTHING to do with trying to get something that you don't have coming to you, but IF you have injuries, you may be compensated for pain and suffering.
