if you sue someone for that most likely you wont win, so you would be a dumb *** for trying because you would not only loose the suit, you would also loose money for the court expenses. So the point is that you can sue and get some monetary gain and pay for your expenses and have a little extra for yourself, so you can buy a new vehicle.

Im prob just gonna take what his insurance pays me and save up some money and maybe my parents will help me out and buy a knew ****n car, **** it I never really liked exploders anyway.

You will absolutely win, especially with witness testimony. If you try to add-on all kinds of injuried, you are probably less likely to win. Suing for "monetary gain" is called insurance fraud. You sue for what you deserve, and nothing more. If your case is strong enough, it will hold up.

*Edit* Maybe I misunderstood your post, it is 4 am. But you get my point anyway.

 
Its not insurance fraud if you stait in the suit that you are sueing so that your truck can be fixed (thats what i said in my post suing so you could get your truck paid). And its not even insurance fraud, because he would be suing the person that hit him not there insurance company, insuracnce fraud would be "staging" a break in, in your car, and claiming on your insurance that equipment was stolen.

 
Im not sure if it will work now, but as soon as you can (especially your girl with the hurt neck)i would go to a hospital, Maybe in the morning after you sleep, and tell them that her neck hurts horribly, and go talk to a reputable lawyer, Not an "abulance chaser" or one of those TV lawyers. And they will tell you what your legal options are. But now days with todays laws you can almost sue anyone for anything.

Thats why i stated that, always go to the hospital first

I didn't realize that you could sue someone for a car accident privately. That's why people get insurance. Also, there are other types of insurance fraud. If you claim that your neck is in excruciating pain and other things that aren't true, you're lying. Faking an injury is definately fraud. (Not saying that he isn't legitimately injured, just making my point)
