here is my understanding from a guy that is a state cop that comes into work all the time. they (the tailgater) will get a ticket for tailgating. HOWEVER, if he suspects that you "brake checked" him, you can also get ticketed. but the fault still comes back to the tailgater.

as far as the question is concerned hit your brakes, if they hit you in the back end and you are going forward (so you can't back into someone and get away with it) its there fault, if they hit you in the back and your making forward progress they were following too close. as far as the fast lane thing, there is no "fast" lane there is a passing lane an technically you can recieve a ticket if you stay in the passing lane.

the worst ones tho, are the ones that get on your *** and HAVE ROOM TO PASS but stay on your *** just be dicks. those are the ones i brake check (i drive a 1500 dodge ram and i keep the hitch in on purpose, been rear ended 3 times with no damage to my truck... but a hitch thru your grill will mess up your day, shouldn't have followed so close) but if someone is just riding too close and its rush hour traffic or whatever, i don't even bother ill slow down to about 10mph below the speed limit like im driving miss daisy.

thats an easy one to combat tho, all you have to say is something ran across the road, and the person who hit you can't say "no it didn't" because they were obviously following too close(they hit you didn't they) there is no way they could see around your vehicle

You guys who brake check tailgaters are probably the same people who travel in the left lane going all slow instead of using it as a passing lane.

I ALWAYS tailgate people going too slow in the left lane. I'll flash lights and beep if they are going slow for a really long time and don't move. Beeping and flashing rarely works, which is stupid because them moving over would be safer.

I'd say 75% of the time it results in me passing in the middle lane or right lane. I immediately move into the left lane fairly close to them and speed up to normal passing speeds, so maybe they get the idea. Again people are stupid, I think only about 2% get it and move into the middle lane.

The absolute dumbest are the ones who travel in the left lane really slow with no one around. You come flying up on them, they see you coming, and move to the middle lane. YOu go by, then they MOVE BACK TO THE LEFT LANE TO TRAVEL SLOW. How stupid do you have to be to do that!?!?!

i don't drive fast enough to bother with the left lane anymore, gotten me in trouble, i hada 92 prelude SI with the H23, and i had a 96 mustang cobra that had a vortech s-trim at 7psi... i used to be that guy in the left lane honking cuz someone wanted to go 2mph faster than the people in the right lane and they thought that was sufficient to ride the left lane. but even when i was screaming around doing 90mph on the highway i didn't ride the left lane, its for passing only, people who think they are fast cuz they go 5mph over the speed limit and ride the left lane deserve to be run off the road. now if someone was ACTUALLY PASSING and i came up on them i would give them time to get back over so i could get around them and then i myself would get over into the right lane. people don't know how to drive these days.

and the whole his word against yours if you break check them. the point of it is that if you say something ran out into the road, its not his word against yours because if they were following close enough to hit you there is no way they saw whether or not something ran out in front of you, so its your word against nothing.
