There is NO law that says a person cannot work for free. The law is that you must be paid if the employer requires you to work, or if the employer knows you are working and does not pay you for it.

Answer the questions:
What is the federal, state, or local punishment to an employee caught working off the clock?
Where does it say it is against the law for a person to choose to do work without compensation and without their employer knowing about it?
Who would enforce the law?

Even if it is YOUR CHOICE to do work off the clock, it is ILLEGAL. Penalties? You can be fired your employer can be fined.
