i got the bypass valve too tho ... except they sent me the wrong size so i need to get that squared away

Looks tight. Don't worry about the splash thing. It won't really matter unless you are driving in a constant puddle for an extended period of time. Even so, the intake is still around 20+inches off the ground most likely, and if you are flooding at that point, a cold air intake is the least of your worries.
