It certainly could be. 1A is not just about "speech", as in "talking to someone".

It may seem crazy to you, but **** is protected by the 1A in the same way that other activities that might happen in that same classroom could be. As far apart as they may seem, a Bible reading and filming an adult act fall under similar protections.
The law and the COTUS work like that.

Who in the world would have believed it was OK to burn a US flag until the SCOTUS confirmed it was? As a kid, I thought you would be jailed for letting the flag touch the GROUND.
Prior to my childhood, kids were kicked out of school for not SALUTING the flag (it was against their religion). Then the SCOTUS said "You can't kick them out for that".

See my previous posts about my opinion on handling classified data. I'm for nailing all these bastards and quite perplexed that classified docs are handled so loosely at 1600 Pennsylvania Ave, so yes I'm thrilled. I'm not sure how this destroys the "rule of law in our nation." As a person whose held a Top Secret clearance in the Marines and Classified at DHS, I can guarantee you they would have hung me by my balls if they found out I had a treasure trove of classified docs in the trunk of my car or in an unsecured closet. Are you not happy to see that one of these A-holes is finally being held accountable? I know I am.

Unfortunately for Trump, once he was caught, rather than cooperate, he decided to cover up his crime and often times the cover up is worse than crime itself. IIRC, Hillary was moving her private mail server around, so the same (a cover up) may apply to her as well. Were you not a supporter of the "Jail Hillary" movement back in 2016? If so, then what's changed your mind when it comes to Trump? Should Trump be held to the same standard he (sort of) applied Hillary Clinton or are you saying Trump deserves a pass because "he" gave Hillary one?

IIRC, the FBI/DOJ said her actions didn't rise to the level of criminality. In the case of Trump, I think it's the lack of cooperation that separates him from Biden, Pence, Obama and who knows who else that removes classified docs from the WH.

Yes Biden is under investigation for 5 mill bribery as vp so file suite on trump. As for the docs trump had was operation crossfire hurricane which was doj Obama and hillary spying on his campaign. Which trump had a law suite on spying with Hillary which was dismissed weeks after his raid. Idk

I'm not defending the action, I am saying it may very well be legally protected.
I am a big advocate of consistency, especially when it comes to laws, protection of rights, etc. My father was VERY against the whole "Do as I SAY, not as I DO" mantra that a lot of people lived by. He was a fair man, and would never expect someone to do something that he himself would not do. I operate the same way.

IF this action by the couple falls under the guidelines of free speech, then it is free speech whether people like the "speech" or not. Legally, no different than flipping off that cop who gave you a ticket. The cop may not like the "speech", but there is nothing they can legally do about your expression. We may not like someone openly carrying an AR-15 in a WalMart, but if it is a protected right and being done legally, then we can't do a thing about it.

Like the earlier analogies I have made, the laws should be applied consistently or they really have no value at all.
