see, she clipped him...but even if she didnt...how about Reckless Driving?

she caused the accident so she should have got SOME kind of ticket.

 
they will place blame on her and her insurance company will have to pay out....but they would pay alot more if the truck was driveable....yes i read that it said she clipped him but in the pics it didnt show any damage to the side all was front end impact.

 
I was broadsided in a brand new BMW 325xi in a parking by a woman in a CRV doing 25-30 IN REVERSE. She jumped out of the car screaming that I was in her blind spot. Minimal damage to hers and serious damage to mine. She looked at both cars and said: "No real damage, let's just forget about it." I called the police. She burst into tears and demanded that the cop write the report to say that she crashed into me, but I was in her blind spot. He was happy to oblige.

A few hours later, her insurance company called and said that the woman was sticking to the "blind spot" defense and refused to believe that she was at fault. He didn't even suggest that I get several estimates, just sent me to the best body shop in the area. They did a fantastic job. i was in an accident just on 6/20 where an eclipse(woman driving on cell phone) stopped abruptly, so i down shifted to 2nd and stopped on a dime(not literally) the honda behind me slowed and pulled to the right a lil as to avoid hitting me...but the assjack in a ford ranger was playing with his dog and didnt stop in time pushing the honda into my right rear qp...caused very minimal damage...his insurance company called within 2 days and was sending an appraiser out to look at the car...long story short after a month of a foot sized dent i sold the car and also got a $526 check for the dent to be pulled painted and cleared....so depends on the insurance company on how they deal with things.

 
and the back and neck will only work if u can prove that the accident caused the injury..as you didnt complain about injuries when the authorities showed up...if you would have then you can draw neck and back pain out for years.

 
I was being facetious.

My wife and son were in an accident in Dec '06 [not her fault]...she had a back injury (not faking....chiropractor and all)......here we are 18mos later still waiting for the attorneys to work out a settlement.

Funny thing is, if it wasn't for the other lady's insurance company [Progressive] being such a complete douche and PITA (calling multiple times a day for weeks straight trying to get her to sign a "medical release form") she probably wouldn't have even got an attorney involved.

 
i just went through something like this. Rearended by a guy in my baby and im gonna let u know now with custom work and such the insurance is gonna be a pain in the ***. Make sure you document any work missed and gas money spent for anything you have to do. Also dont take no for an answer and get multiple quotes. I know it sucks but make sure u make this as positive as you can.

So wait, you are saying they would pay me MORE money if the damage sustained to my truck had still rendered it drivable? How does that make any sense? lol
Its hard to see from the pics, but the driver's side did sustain damage all the way back to the rear wheel, including bursting the rear tire and scraping the hell out of the rim.

 
Thanks guys. Yes, its her fault. There were even witnesses that agreed she was totally to blame. Im just now startting the insurance crap, the police report will have to be issued before I know more on that. Bbut Im assuming at this point I will be reimbursed for the truck. The install however, all those hours, sooooo close to being done... I wont get compensation for. At this point Im just gonna be making sure I get a new vehicle out of it. Then start all over again. *sigh*
Oh and not to get too personal, but my g/f of 7 years and I have been fighting lately. I got home from the wreck to find a message from her that we are through. Awesome day! lol *slouch* Fucking bitches I swear. When is man gonna invent a mechanical ******????

Truck is back at my place now, equipment still in tact. Its funny, when the front end smashed in the red-top, instead of smashing too, popped straight up into the hood. Kind of amazing it didnt crush. I'll take a pic to show you. BBIAB with some pics.

I forgot to mention earlier, the subs hadn't been installed yet. If that box had had another 150 lbs of top-heavy weight on it, Id have been in trouble. heh

Your lucky man, just look at it that way.

Let this be a lesson for those putting sub boxes on the back seat or in SUV's unsecured.
The fact that his box was bolted down basically saved him severe injury. Sure the box failed, but the amount of energy absorbed BEFORE it failed is what matters.
