The RIAA is after me........

**** there are some stupid people on here...

1) No they DON'T need to hack your computer to get a list of your files... remember YOU are on the net with your **** P2P letting the world know what you have in your shared folder.

2) This is a civil matter, I doubt the government would help the RIAA out.... especially in consideration of #1

3) It's your **** fault for sharing or using programs that are KNOWN to be watched... but it can be done in so many ways that won't get you caught... newsgroups, IRC, Waste (if you have friends)

4) Quit being stupid, you ARE stealing from the record companies and it's childish to justify it. If your're going to do it at least do it in a way where you won't get caught and quit being arrogant and saying "they can't do that! P.S. I think the RIAA is shooting themselves in the foot. They always resist new technology that generally turns out to make them more money in the end... It's also stupid that they blame their financial downturn on p2p's... it's because we had a recession and then they haven't made any decent music since around 2001... it's their god **** fault....

 
ohh yah and firewalls won't protect you because even if you have a properly setup and working one YOU are going outside of the firewall and poking a hole in it to share your music.... of course a proper firewall wouldn't allow you to use p2p programs....

about the only thing that *MIGHT* help is a spoofed MAC address which gets you a new IP... but I'm not sure if the ISP can't work around that... it may be very easy... but if your willing to spoof mac addresses and setup firewalls there are just plain better ways to go about your stealing of music...

I don't think the federal DMCA law gives anyone that authority, if I'm wrong what title can it be found in?

There has been a push lately by the MPAA, and others, for increased state legislation like the DMCA. Some of the proposed state laws did include provisions like the one you describe, but I'm not sure if they ever passed and really don't know a lot about them.

However i do know a little bit about the federal DMCA bill and I'm not aware of it granting the right for the RIAA (or anyone) to hack into a persons personal computer.

The RIAA got the screen shots because they pay agencies like Ranger Online to cruise the net and find copyrighted content on p2p services and report it. The whole things is rather automated by the system implemented in title 2 of the DMCA, the Online Copyright Infringement Liability Limitation Act. The act set up a safe harbor for ISPs against liability for copyright infringement if they follow certain guidelines. It in no way allows the RIAA or MPAA to break into someones computer looking for copyrighted material. It just protects ISPs from any liability if they follow certain rules regarding notification and removal of copyrighted content.

If i am wrong point me to information supporting your point, as i am interested in the subject; I am certainly not an expert though.
