i didnt give him permission to search car. i was patted down for weapons even though i refused to step out the car. he kept implying and put his hand on my door as if to open it. at this point he is using force which is also illegal but i have no choice to comply as i "do not want to be a victim of police brutality". i did not let him search vehicle. but there was a baggie with a pill in it in the dooor handle. he shined the light on it and saw. hell from there.

CDS in plain view = automatic probable cause for a more thorough search with absolutely nothing you can do about it legally.

THERE has to be probable cause. even though he saw drugs in plain view the first question is "why was he pulled over?" stop sign? ok why wasnt a stop sign ticket givenand why wasnt that reason included on the report? i owuld actually believe some of you if you were a lawyer. but i think ill believe what my private lawyer says, thank you very much. and requesting for dash cam is noobness as cops turn on and off at their own discretion so all the cop would have to say is oh i didnt have mine on even if he did. its that simple. my lawyer already anticipated i would ask him that and told me that requesting the dash cam is a noob move for that reason alone.

Your legal counsel is as much of an idiot as you are, seemingly.

Whether it is a "noob move" or not in your/his estimation because allegedly the odds of it getting produced are questionable a defense attorney failing to ask for that particular piece of evidence (if the main theme of the defense is going to be improper traffic stop to begin with) is a completely n00b move.

Tell him to go back to school and actually pass the bar prior to trying to practice law ~ anywhere.

In most (if not all) jurisdictions nowadays a beat cop having that dashcam on and recording during the entirety of his/her shift is standard procedure.

If the dashcam vid detailing the specific timeframe in which he had you stopped cannot be produced then that opens up a whole 'nother ball of wax altogether and brings to the party a lot of tough questions the police department isn't going to want to answer - which is definitely an AID to any defense strategy.

I do not have to be a lawyer to have common sense, fella.

I do, however, have enough knowledge of how the criminal justice system works, fails to work, and can be worked if you just use a bit of the ole gray matter God saw fit to give you.

I believe you should go to jail. You broke the law. Trying to come up with a reason to get off is asinine. You got caught with drugs, not just something as simple a weed, but a drug that kills people just from swallowing it, let alone the dozens of other stupid things it makes you do.
