"NEW" Subwoofer came USED/DAMAGED

If you buy a subwoofer in "new, unpowered condition," yet upon shipment it shows obvious signs of use/damage, what is the fair solution? I figure if it's broken, it should be fixed. That's a given, right?

What, in your opinion, is a fair middle ground?

 
Send it back and tell them to shove it up their behind - and give you your money back...
