its not just over 18 and under 18, at least when i checked it in VA there also had to be a certain age difference, i think it was, girl had to be under 16 and age difference had to be 3 years at least. If these weren't met but you were over 18 and she was under, then its just a misdemeanor

VA law boils down to this: If they're under 18, you must have parental consent and the ages are as follows...

16 y.o. with a 19 y.o.

17 y.o. with a 20 y.o.

under 15 = Crime

18 and over who gives a shit...

Not sure as to felony or misdemeanor, but it is considered statutory **** as in against the statute (regulation) weather it was consensual or not.

FYI, since I AM in the military: Service-wide according to the Uniform Code of Military Justice (UCMJ) 16 and 17 are legal for any age as long as there is parental consent (Kind of awkward asking that one), but you must also follow local laws.

This keeps people from going to Thailand and buying 10 year olds... Well, legally, that is...
