How to deal with bad seller on eGay?

So my roomate ordered a 500/1 last December, and when he got it, it was in a box significantly bigger than the amp, and the only packaging was one sheet of the thin bubble wrap around the amp. So, during shipment, the amp was bouncing around, and even broke off one of the cooling fins.

So when we got back to school in January, we go to install it, and the amp is busted. We cracked it open, and lo and behold, there's a loose component in there. He filed a PayPal claim against the dude, and after a ridiculously long period, he won. So now, the dude is threatening to close his PP acct and take my roomate to court over a $200 amp.

My roomate has thorough documentation of the whole transaction... pics of the amp when he got it, pics of the crappy packaging, pics of the loose component in the amp, pics of the broken off cooling fin, pics of the amp when he sent it back to the dude, and how it should've been packaged. Not to mention all the emails and stuff.

How should he deal with this asshat?

 
If he paid by credit card thru paypal, see if the credit card company will allow him to do a chargeback. Most have a time limit of 60-90 days though, so if this happened in December he might be past the time limit, or rapidly approaching it.

Also from what I've heard, paypal doesn't like chargebacks and it's possible his paypal account will be closed as a result. But if that's what it takes to get his $$ back......

he ended up getting his $$ back, and now the dude is talking about sending him the amp back... I don't know why. It doesn't make sense to me. All I can think of is the dude abandoned his PP acct and took his bank acct and credit card off, and doesn't care that it's negative. He still has his $200, and is okay with that or something. I don't know. Im f'n confused.

but if my friend ended up with his $$ back and the broken 500/1, that would be balla. he can't deny the shipment, because it goes directly to my school's mail room. if the dude mails him the amp back, is there anything he can do? i dunno.

I would be careful with that.

There is a thing called "unjust enrichment". The seller might be thinking of trying to go back to paypal and claim the buyer (your friend) is "unjustly enriched" by having both possession of the amp and reimbursement for the purchase. Since it's "not fair" that your friend has both the $$ and the amp, he might be able to (or be planning to try to) talk paypal into taking the $$ back from your friend and giving it back to him.......leaving your friend with the broken amp. Now I realize he is sending the amp back after he received it from your friend and the refund was made, but he may be hoping that paypal won't pay attention to the details and just hit the refund button.

Not saying this is actually what he plans on doing. Maybe he just has no use for a broken amp & thinks he'll be screwing your friend over by sticking him with it.

But it's something to think about.......
